  1. Phil, when I said it isn't a trial I was implying that unlike a trial, the matter is generally not open to debate. An end user is served notice with a general statement from the TOS and that's it. If you violate the terms of service they can deny your service period (paying customer or not). Some issues are completely black and white; for gray areas most TOS's I have seen specifically state that they can deny your service when they deem fit (paraphrasing). Obviously they felt your conduct was not appropriate based upon the general guidelines they have. I can see why they did it. The thread was a trainwreck. You're right; In terms of dollars, it wouldn't be a worthwhile venture to pursue legal action; I never debated that point. You take the suspension, lick your wounds and move on with your life.
  2. Phil, It is not uncommon to receive a notice which does not include specifics regarding your case. It isn't a trial, it is a denial of service notice. As Whirly pointed out, those notices generally are specific to a portion of the TOS that was violated. Right or wrong, that is the practice and it is quite common on other online platforms as well. The penalty for those violations are rarely overturned, or open to debate. I don't think its appropriate to discuss the details of of your case here; but I'd think (outside of the wrong clause being sent to you) that you'd have an idea what the root cause was.
  3. LL isn't going to act as a guarantor and being that this person is from another country; if they decided to walk away, the cost in terms of legal fees will far exceed the money you lost. Clearly this is some kind of scam, don't be a fool and you won't become a victim.
  4. Just to piggyback off of what @Dakota Linden said. I am not sure if this applies to any of the vendors here, but please include links to your MP store and storefront in your Flickr posts. I can't tell you how many vendors don't include pertinent details including, links, dates, etc. I have literally had to e-mail, send a NC, or an IM to some vendors asking where their MP store, or storefront is because I was struggling to find it. Not everyone is willing to work that hard, and in some cases, I too just simply move on. Here is a great example of one vendor I follow.
  5. Belleza is working on a Bento update. The delay from what I understood is that the HUD will also have to be updated; and it is quite possible that other changes are coming in the update as well. As much as I am looking forward to having Bento back (I also own Maitreya), I am going to wait it out and not go third party.

Teagan, more then likely if the garment does not fit the body it was labeled to have been rigged for; it was either not rigged properly by the creator or done experimentally and in some cases not labeled as such. I had the same issue you described a few years ago when I used a body by TMP. Unfortunately that body never gained widespread support (for varying reasons) and I grew tired of seeing all of the clothing I couldn't wear because it wasn't rigged for my body. I eventually threw in the towel, and bought a body by Maitreya and it made all the difference. While I do own bodies from other creators, there is no doubt that if you want to own a body with the widest support; it should be from Maitreya.

  8. People are still people sending money to Nigeria to unlock their fortunes, so this doesn't surprise me one bit. Too bad some can't be bothered to comparison shop, or have a clue what fair pricing is.
  9. btw, speaking of last names. Was "Darkfire" the Smith of SL? I can't tell you how many times I have seen that last name used. I'd be curious to learn about its genesis if there is a story to tell.
  10. Phil, everyone is on an equal footing in regards to content creation. While the process of building has evolved and become more complex, so have the creations we are now able to make as a result of those new tools. Blender is free to use and available to everyone. So the choice really is up to the end-user. If by equal footing you mean artistic ability, well that is out of LL's hands. That new user to second life had access to all of the tools you did (as they do now) ... The lack of in-world shopping has more to do with the will of consumers, and less to do about LL. I for one still enjoy shopping in world from time to time, but I love the convenience and ability to locate items that I might never find just randomly roaming the grid. That freedom has allowed me to give business to those that I may not have discovered, if not for the marketplace.
  11. Max, the marketplace was not created specifically for content creators. It was designed as a platform to buy and sell goods; so charging a fee solely for resale merchants to sell those goods would make no sense. If anything, those increased costs might then be passed on to consumers. No thanks! If a vendor feels that investing into 30 advertisements is worthwhile for their business, then that is their choice to make. I'd wager that many would argue that is probably overkill from a ROI perspective, but more importantly that marketing isn't coming without a cost. Is it fair? I think so. A larger business is going to have more profits to invest with; giving them an outlet to invest those profits and grow their business is healthy. Limiting the number of items I can upload daily accomplishes what? If I'm a vendor that is releasing one or more products with unique colors; now I'd be forced into having to upload it over one, two or even three days? All that does is creates a hassle for some vendors as well as consumers.
  12. I prefer (although not always possible) to have copy/mod rights on my furniture and decor items. As others have already pointed out, with copy rights, you can duplicate the item for use elsewhere. Outside of what Anya suggested; I also see the value in copy for the following reasons: If I mod a piece of furniture or an accessory, I can now have an original copy in addition to my modded copy. This saves me time, and allows me to more freely mod without worry. If you plan to change homes, or move at some point, but want to preserve your furnished home; you can pack it up in its entirety and still have the freedom to use any of those items in another build. If its no copy, you will have to pull those items prior to packing, or if you decide to pack the home with those items, you will not be able to use them until you unpack that home and retrieve them. With copy, you essentially have a backup. If you delete the item (either from your inventory or from in-world), you can just unpack another copy without having to deal with content creators or redelivery systems. In the cases of gacha items, you're SOL.
  13. I hadn't seen it mentioned before, but you can enclose the skybox in a dome. Typically they have sky settings, some offer weather effects, and they do also give a greater sense of privacy. I have seen some people do beachfront properties inside them and they were quite nice.
  14. Chris, if the product is a Maitreya exclusive, I'd encourage her to try on the demo anyway. I wear quite a few pieces that are Maitreya exclusive on my Belleza body. Results will be hit or miss, but with some minor shape adjustment, alpha's and hair; I've had to avoid going back to my Maitreya body in some cases.
  15. My perception of it was that she was on the same page, but you were getting hung up on her using the term "active" as if she was calling you out; when in fact she wasn't. I just wanted to say something so there wouldn't be any animosity between you two. As they say, most arguments start as a result of a simple misunderstanding. This thread delivered that in spades.   16. I am not even sure it is a question of word anymore. Phil's claims match exactly what is posted on the website. Based on the data there, it suggests that he has not been a participant outside of those 2 occurrences, and I haven't seen anyone here debate otherwise (including BilliJo). As Solar suggested, participation was not required to hold an active account. In the same vein, If I create an e-mail account, it will still be active regardless if I ever use it again. It really is just a matter of context ...
  17. I don't know what type of volume you do for your store, so I won't make any assumptions but a stated refund policy in itself isn't a bad thing. When people say the "masses" in this regard, it doesn't refer to any and all customers that have an issue, it just means that it is a measure to minimize it from occurring. If you've ever worked in retail, you'd know this.
  18. Hopefully in the future we can all shop events from a HUD like Pocketgacha. No lines, no lag, and shop at your own convenience. If I am attending an event within the first week; other avatars are either de-rendered, or turned into jelly (great experience right?). So what exactly would I be missing out on if I did it via a HUD instead? Seraphim also has a FREE HUD that you can use in-world that provides a direct TP to the event, a link to see what items are available at the event and a few other goodies. Highly recommended to use in conjunction with the website.
  19. The policy of no refunds is to stop the masses from asking for a refund. This same theory holds true for many RL retail establishments. But blindly saying you will never give a refund is short sighted IMO. A customer in need creates an opportunity to strengthen, and or affirm a relationship. It can also be an opportunity for you to dissolve a relationship. The choice is yours. Saying that many creators left because of bad reviews is just affirmation bias. Bad reviews happen, its a part of doing business. What you as a seller can do is look at at those service issues and determine what changes can be made on your end to prevent, or minimize future issues before they happen. At the end of the day, the more reviews you have, the less impact one negative review has. If you offer a product demo, those reviews are further negated. Instead of a merchant reviewing a customer (*which sounds wrong on so many levels), they could make all reviews completed by that customer available to see (i.e. Yelp). However, I think even that would have a limited effect given how easy it is to create an account.
  20. Personally, I like the head being Omega compatible (not just the makeup layers). If I really loved the head, I could probably do without, but that feature does give you a lot more flexibility with skins which is a definitely plus. I was also a bit turned off by not being able to experiment with the HUD, and see the animations. I just don't see the reasoning behind that. Have you tried Lelutka? I have seen similar shapes being used on that head.

  22. You could also do a redeliver and use another HUD. The new one should be in the correct location.
  23. Like Bree, I also rent on a private estate and quite happy there. I can't say I'd ever be against living on mainland, but then again I've not given it a ton of thought over the years. The great thing is that the option is there, and people can live where they choose too.
  24. That would be the kinda thing that would drive me bat s@#$ crazy! I had a skin for one of my mesh bodies and I hated how my shoulder blades looked with some of my shapes. I couldn't but help look at it all the time. I finally had enough lol.
  25. Whether they like it or not, the vendors incidentally created the framework for the secondary market and thank god for that. Some vendors offer a copy mod version, some for free, in some cases for an additional fee. These days, we don't hear so much grumbling over the matter. They are content making their money and some of us are more content with buying on the second hand market. To the OP, like Alwin said—there's more to this story then we're being told. If you come here seeking advice, we need the pertinent details without the melodrama.
