Genus is back!

To file a dmca with LL you have to send your name, address, signature and a statement that you are telling the truth that you believe your copyright is being infringed. Lying on a dmca takedown request opens you up to perjury which can be a felony. If Genus files a counter claim they send all their contact info to LL which goes to the dmca filer and LL must restore Genus in ten days if Genus has not been served a court order. So, after ten days from the last request we should see Genus restored unless they really are getting sued.

I think DMCA was basically Napster panic.

Remember back when so much music was being shared around on ripping services, and some like Napster were even getting Silicon Valley funding to build copytheft platforms...

DMCA was an attempt to stop that... that was not aimed well.

iTunes, Spotify, and so on showed that a better solution was catching up with technology.

I feel like there must be a real case here, like others have pointed out you can't really file DMCAs frivolously or anonymously, so Genus knows who it is (regardless of what they claim - if they don't know who it is, the DMCA isn't valid), and could sue.

They would know the real name and address of the person filing, but may not know who they are in SL.

Even when you have a solid case to sue someone, it might not be viable. They might not be in the same country/continent and hiring lawyers costs money, often more than you'd be able to get from them.

We just lack the intel to really speculate for or against any party.

To not be open to a DMCA, your item has to be free of someone else's IP.

If the item was say... based on a 3D model from somewhere outside SL, even if heavily modified it's sill a violation.

It it's not, it's not... but the DMCA system puts the burden of proof on the defending party... not the accuser... which means it's easy for accusers to just keep piling on accusations...
