Is this fair?

Greetings, one of the main reasons I come to sl is to play zango,  and I spend a fair amount of $L at a sim (EOS) where I received a invite to the local group that gives $L incentives for playing there. While playing a game I was ejected and banned from the region. Immediately after I received an ejection notice for the group, I sent several ims and notecards to the owner/moderator that were all ignored. I simply asked in a polite manner why I was banned.....no reply.  A short time latter I tp to another sim where I saw the owner. I sent another asking why. The response was I found my self ejected and banned from this region also after which they immediately logged out of sl.  I have done nothing to violate the t.o.s. and have always been courteous to other residents. If these were justified actions why not state the reason instead of being rude and hiding. Just wanted to hear your thoughts.     TY

 

P.S. I am well aware that sim owners don't need a reason and are not obligated to respond to my inquiry Just  thought it not good practice to treat patrons who have violated no rules of LL or the region in this manor.

You don't have to violate the ToS to be banned from any region or sim. Those are paid and owned by different people and they have the ability and right to ban whoever they want to. Their homes, their rules.  They are also not forced to give out any reason for a specific ban. Sure, its sometimes not fair...but thats life and even the second life isn't fair either.

My personal opinion is, that Zyngo and similar games are a shady business. I don't care if they are not banned. They sneaked around the "no gambling"-rule, but are basically not more of a skill-based game than any sort of gambling. I'm not suprised that owners of big Zyngo-places have also shady businesspractics.

Fairness has nothing to do with it.  According to the TOS, a land owner or their agents can eject and ban you for any reason at all or no reason at all.  They are not required to tell you the reason either. Since they are the ones paying LL the tiers, they have full control over who can be there or not.

All you say is that you specifically didn't break TOS.  Breaking the TOS is one thing but you are also required to follow any rules the venue owner has whether you think they are good rules or not.  Only you know if you did something that broke the venues rules.  I am not implying you did and it doesn't matter at this point anyway as it is water under the dam. 

If you are really sure you did nothing to deserve this, then why would you want to go and spend money at a place where you are treated like this? Move on and go somewhere else to spend your L's where you are welcomed.

Fairness indeed has nothing to do with it, as has been ponted out. You say one of the main reasons you came to SL was to play zango (zingo?) and I'm guessing that's some kind of game of chance passed off as a game of skill, but in any case a game where you pay money in the hope of earning more money than you've paid in.

I don't care what LL wants to call that, but the usual word for that sort of thing is gambling. Merriam-Webster has this definition for 'gamble':

: to play a game in which you can win or lose money or possessions : to bet money or other valuable things

: to risk losing (an amount of money) in a game or bet

: to risk losing (something valuable or important) in order to do or achieve something

Maybe you are an extremely lucky skillful zango player and were getting a higher return on your payout than usual. Or, possibly, you'd figured out a 'system' and were somehow beating the odds being more skillful. In either case the sim owners might have said, "Deathberry here is winning! Ban him!".

They can do that.

Exactly. They can, and do, prevent people who win from being allowed to play. It's not a secret. I was just suprised that someone would think SL should be any different in that respect.

It actually surprises me that any of these places still exist in Second Life, although they must be working within the rules of the Terms of Service, otherwise they wouldn't exist.

Whether or not the sim owners actions are justified, they can care less than they would have to in real life. Being rude and ignoring patrons is certainly not against SL's Terms of Service.

All you can actually do is seek out other places in which to exercise your machine playing skills; there are still a fair few around.

I am assuming that the reason for the ban might be personal. Maybe you have flirted with someone that the sim owner was fond of and it upset them. I was banned once because I was talking to someone and it happened to be the sim owners husband. I was unaware but because she caught him flirting with me she banned me. It wasn't a big deal to me but a friend wanted to do some snooping and asked her.

My friend also got banned from the sim because she talked to the husband. She was able to get back in once she explained she was a lesbian and that wasn't happening. She was able to talk to the sim owner and tell her that I was unaware of him being attached. I was un banned but there are others who wouldn't care either way. They will ban you if they feel their  "property" is being messed with.

Well if you were actually winning money, then just make an Alt go back to his sim and clean him out, repeat until he is broke.

Assuming that game works like that i have no clue, to me its like those guys who sit at the video poker at a restaurant/bar.

is not fair. fairness is that the punishment do not exceed or be less than the damage caused by the offense commited, if you cause no damage, is unfair that you recieve any punishment.

not offering a chance to appeal is even more unfair, because the decision for punishment is taken from just one side of the story, which means that is highly biased.

don't be too worried about not having access to those sims owned by a rude person, the good news is that you are not going to have to deal with that person again, if you enjoy playing the game, there are probably many other places where you can continue playing and earning lindens, zango is popular. if that sim dont want to have a chance to earn your lindens, their loss.

You can always go and buy your own zyngo machines - set them up on some land after buying such - and play away.

If that does not work because you want to make money - you might have been banned for being too successful and costing them too much.

(I have no idea how the game works, but if you're winnings come from the land owner - then I would fully expect land owners to ban anyone who is skilled enough to win regularly... They after all, are hoping to use the game to prey upon the addictions of noobs - and anyone who actually masters the game becomes a threat to their business model.

Zyngo is gambling, casinos don't like winners. People win in casinos, they're quietly worked out the door.

In SL that means being kicked out of the region and/or group, and banned if you return.

RL that means you find your courtesy room suddenly has no hot water, room service is late and the complementary burgers overcooked, the fries soggy, the wine at the wrong temperature, and cola dead, the toilet in the neighbouring room suddenly so loud you can't sleep (and the person in it apparently has diarrhea all night long).
