Consumption of CP is also illegal.  Meaning, watching it, be engrossed in it.   Whether it's recorded or not, in respect to SL, wouldn't matter.  You're watching/consuming it.

doesnt matter, if there is no physical record, either a photo or video, there is no crime, you cant be guilty of posessing CP, because it doesnt exist, and thats the crime, not engaging invirtual pedo sex.

An artist paints a lewd picture of age-play with children in his private studio.  Then he says, ehh, that will never get by the school board for the high school flag.  So he burns his painting.

Did he commit a crime?

(Note the artist was Canadian.eh?)

Look it up yourself...

that was years ago wasnt it? The artist was found not guilty because no children were harmed, and it was his right to artistic expression.

Of course, i m sure the laws changed since then

its only a crime it you record it 😂

an adult having virtual sex with an adult playing a child is not a crime

Such depictions are illegal in the USA. Our avatars are considered artistic/creative works and expressions and are subject to the same laws that regulate obscene or illegal content in other visual art forms like drawings, digital art, etc.

Avatars in virtual worlds like SL aren't exempt from laws governing obscenity, indecency, and other illegal depictions, even if the activities are kept private. There's no legal loophole that allows the creation of obscene content just because it's in a private virtual space that others can't see. There's no "get out of jail free" card that protects such content from laws just because it's relegated to a private virtual world. Our activities are not actually "private" or protected just because others can't see it live.

what part of “there has to be a physical record of the act to be charged with posession  of CP” do you not understand?

Their conversation alone would be enough to prosecute them

Wrong answer. The painting was destroyed before anyone but the creator, the artist saw it.  The artist burned it the same day he finished the painting.  Laws about fictional pornography can not apply if there was never any evidence that such pornography existed.

Just like someone engaging in SOLO SEX in SL with himself, and does not record the animation, has exposed no one but his own eyes and memory to that animation.  He happened to have on an under 18 avatar at the time.  You think that is a bannable offense?  My quiz was about a solo painting that no one ever saw before it burned.

What some of you puritans are saying is - if you make an image and then destroy it, so it only remains as a memory in your own brain - that this is a crime.  Have you never had an illegal thought in your life? Not one you ever spoke or revealed, but a secret thought in your brain?  Should we arrest you for that?  Get out the brain probes and let's recreate your brain image to show to the  judge.

Behaviors depicted virtually through avatars in SL, even without screenshots or recordings, could still potentially be prosecuted if they're obscene or illegal. Not having a video/image record doesn't automatically make the activities legal or unprosecutable.

Chat transcripts that describe obscene or illegal avatar actions could be deemed digitally obscene material under U.S. obscenity laws, even without visuals. So while a visual record could make an easier case, the lack of one doesn't make avatar actions immune from obscenity laws, if the textual descriptions cross legal thresholds of obscenity.

So let me get this straight.  If no one records it, avatars in SL can engage in CP and it's not illegal?  The discussion IS about SL,.right?  My responses have all been about SL.  Others have dragged it into the RL weeds.

It's against the ToS...the law of SL.  But you all just keep on dragging RL into it.  Your RL psychological problems made you engage in sexual AP.  It's not sexual AP if no one sees it.  The hell is wrong with you people.

Linden Lab *will* ban adults for talking dirty if one or both of them are representing as a minor.

Private consensual "dirty talk" is very different from descriptions of clearly illegal obscene activities like exploiting minors.

Before I go aback and read this, can I ask what the point of this discussion is?   Scanning the thread, it looks to me like some of you are trying to justify CP.   If this is the case just let me know so I can write this thread off as a bad idea.

Yup. The police do stings where there is no actual minor involved. Have you ever seen "To Catch a Predator" on tv in the US?

The thread has gone from the weeds into a deep, murky swamp full of alligators and leeches.
