  1. I don't spend any time on Christmas or Christmas Eve in SL. My son and I go to a local children's hospital on Christmas Eve. On Christmas day we go to a soup kitchen to help out. We have a blast at the children's hospital. We're pretty familiar with most of the staff and he really enjoys playing an elf to all the little kids. They seem to enjoy seeing an elf who "looks like them". We have fun at the soup kitchen too, but it's also pretty sad to see. There are a lot of families, and it breaks my heart. We don't do gifts for each other, we use that money to bring things to the shelters that they need instead. We spend the day before and after watching corny holiday movies, though. Same with New Years, we watch corny holiday shows and movies.

  3. You would really charge someone $1700L for that moprh I see in your "gallery"? The one where the face is clearly not blended, you've added a soften where it doesn't belong and you made it look like a literal paint by number gone terribly wrong? (and from my guess, that's a ripped photo you morphed it onto, a big no no) I am all for trying new things, learning new skills, and promoting yourself while doing so. Everyone starts somewhere, and all of us start out at the bottom when first learing. But I would never believe, looking at those photos, you have any graphics experience at all, and I'm really surprised you presented yourself as such. You don't need sl experience to create a morph, or general graphics for that matter. You need to work on your blending skills, a lot. Your prices aren't even remotely near where many what I would deem professional, photographers in sl charge. And they're very much worth it. You've a novice, you're still learning, and you haven't quite got a good grasp on post processing yet. You really ought to take those prices down to more reasonable rates. I am the last one to suggest someone sell themselves short. I also wouldn't normally tell people what to charge for their services. I can however easily see when someone is overselling themselves and their abilities. Sorry to be so harsh but, you're not ready to run with the big dogs yet. You need to spend some more time on the porch first, before you get eaten alive.
  4. There are a lot of places that do this very same thing. In fact there is one very high-on-search club, and I use that term loosely as it's really not as popular as some think, that has many of the staff members park alts there at all hours. They keep the majority of them at club level so it looks legit too. They do this to up traffic and to keep themselves in search. They've been doing it since long before they became what they are. I was around as a patron when the original club they merged from was built. I was also a staff member back in the day, one who refused to use an alt to boost their traffic when asked, so I left. I know they still use them, because I know many of the alts, They made the mistake of telling me. The only reason they are numbered in search where they are, is because of this traffic they've been gaming for years. Without it, this place wouldn't stand on it's own. They get a lot of complaints, I used to be one that had to take care of them, so I know very few would ever show up and stay if it weren't for these bots beefing up traffic. I have learned that ARing them, does nothing, I've done that, and encouraged others to as well. I even provided proof a long time ago, directly from them that they do this, to no avail. No it wasn't just some vendetta of mine, it's just something I don't agree with doing, at all. I've seen a large wave of ARs go flooding in from patrons and staff that were fired, or simply left, when they found out those other patrons aren't actually patrons at all.Most people don't know, and wouldn't if someone didn't tell them. Just goes to show that not everyone shares the same ethics. Those who ARd felt it was against TOS while those doing it, felt it well within TOS. There are some who think gaming traffic is fine. I'm not one of them. Especially for places like clubs where people expect to go and hang out, since that's their purpose. That's the last place you want a bunch of unmanned people. They aren't the only location doing something like this. I highly doubt LL will do anything though. It's difficult to get them to answer most tickets or act on them, as it is. Bots and gamed traffic seem even lower on their priority list. Word of mouth is the best way to get people to not promote that behavior. Though it's not really as effective with clubs as it is stores for instance. People look things up in search, or land there and see a ton of people, and they assume it's popular and full of vibrant residents. When in reality it's likely only 1/2 or less, actual people. Not all clubs do it, but some of the top ones in search most definitely do. I don't patronize those places, for that reason. But I gave up trying to report them well over a year ago. Our efforts were futile. After reading your responses OP I know which club you're talking about. I can promise you that particular one, won't be around long. The original has been around since 2007 and is only getting more and more popular. It's not suffering in the least because of it's newest copycat. Copycat clubs have come and gone over the years trying to mimmick what the original has. They all fail, because it's not just traffic that draws people in. They just don't realize that, and they can't match what the original offers. I don't think the lack of action on the lab's part has anything to do with tiers in most cases. It's just the lab not wanting to act on things at all, pure laziness on their part. Let your feet do the talking for you. Word of mouth can and will be more damaging to the crappy clubs than any AR could ever be.

My guess, your skin isn't actually G-rated at all, since the majority aren't. Unless you're running around naked in G places, you're not going to get banned just for having a skin. But I doubt you're running around naked to begin with, so you probably haven't much to worry about.
  8. Uhh I hate to break it to you but either your wife's account was hacked, or she's not who she's telling you she is. Both are likely scenarios. A linden employee hijacking an av to go for a wild romp in BDSM land, is NOT a likely scenario, not by any stretch.

Even if you don't appreciate the advice given there are likely others that might benefit from it. Beauty of public forums like this is when we post, we're not the only ones reading. That's why I linked to the actual TOS. Not just for your benefit, but others as well. I can be helpful sometimes. Though I try not to sometimes too.

The reason for flagging or in this case removal, is pretty solid.
  11. It's a hard lesson learned but everyone has them, and no one likes them. Especially when it's our own fault we experience them. I think they chose the best method to deal with it. They could, if they so chose to, not allow you to use the MP at all, or remove your content from the grid. No one is entitled to be a content creator in sl, even moreso if we choose not to abide by the rules. By allowing you to relist they are giving you a second chance to rectify what happened. Having to redo listings over, isn't nearly as bad as having your content, or ability to sell your content, removed entirely. Think of it as a silver lining in the situation. It's not bashing you to point out why they did what they did, or why using the brand name was wrong. It's also not beating you over the head to point out the TOS. If you can't be bothered to read them, it's no one's fault but your own. No need to flounce just because people don't agree with you.

Keywords are there for people who are searching, they ARE part of your advertising. They ARE part of your listing. Obviously you're trying to get people to buy your products. What kind of merchant wouldn't? Every merchant wants customers, that's not a bad thing. I didn't say wanting more customers was a bad thing. What you did to get them, however, is not a good thing. That's why your stuff was taken down. You can't use a brand name, at all, if you don't own it. That's not just a rule in sl. It's a law. You don't get to brand your stuff with names you don't own. That's just a reality of being a merchant, no matter where or what you sell. Even using it in keywords is slapping that brand on your stuff. Making you abide by the rules you already agreed to is not going too far. They have to enforce laws you know. They are as obligated as you or I to follow them. I didn't realize following laws, and rules, was always such a bad thing. If you want to call me a stickler then by all means go for it. I prefer people be able to protect the stuff they own. That includes big companies right on down to the little guy. I wouldn't want someone else to use your product or brand name, if you had one, on their products either. It's not right. I don't blame you for not wanting to do the work over, but it's still not the lab's fault you used incorrect terms and now have to redo it. There is also a section all about keyword spamming. It might shed some light for you.

Do you own that brand name, have rights to use that name? My guess is, no. In which case, LL did nothing wrong, you did. There's actually a TOS for merchants for a reason. You might want to read up on it. You're lucky they didn't remove your products from the grid entirely for using a brand, an actual licensed and owned brand name you have absolutely no right to use. So yes, they were being kind to you. Your time may have been wasted, but it wasn't the lab that wasted it. It was you. Your work didn't go down the drain just because you have to redo your listings. If your stuff had been removed with no warning as to why, like most of the things removed, you might have reason to be irritated. You're lucky, they gave you the reason why. Although you already knew the reason before they removed it. It wasn't a mistake it was a deliberate attempt on your part to, as you said, get a spot in a saturated market. If you choose less than stellar methods to get your foot in the door, you shouldn't be surprised when someone decides to slam it down on your foot once they find out.

So in essence what you're really asking is for someone to not only give you a bunch of free textures full perm[red flag for most creators], but also pay you and allow you to take your sweet time "sorting" them? Sounds like a fantastic way to gather a bunch of free textures for yourself. I'm not sure how easy it will be to get someone who doesn't know you to pay you for this, but good luck in your search. I hope it works out for you. I know I have tens of thousands of textures so obscurely named it's impossible to tell what they are without opening them. Most were so aptly named by myself, of course, so I've only myself to blame. It can be a pain going through to rename. I use a storage thing that lets me see them so I don't have to bother now unless I want to. So much simpler and no worries of having my stuff out there full perm for just anyone. I'm sure the creators of those products and ones like them have made a mint off people like myself. If you're looking for ways to make money, creation isn't a bad option. Anyone can create in sl.

And if she did report you I think "she dressed like me" would raise some eyebrows when reviewed. But it does raise an interesting point. Many people work hard on their looks and like to see themselves as being unique. So I can see someone getting upset with someone who has intentionally "twinned" them and looks like them. Worked hard? At buying things? I think not. Unless someone created the look 100% all by themselves, including creating the skin, shape, hair, clothing and any other items included, they did not work hard at it, lol. Others worked hard for them, so they could look that way. People who get butthurt over others looking like them crack me up. Especially those who really make a big deal about it. If nothing else, they provide free entertainment.
  16. LL will not help you, it's a resident to resident dispute. If you want your EULA upheld, you'll need to take rl legal action. I suggest seeking counsel if that's what you really want. Or you could not focus on the very few who would violate it in the first place, if you'd rather not go down that route. It's entirely up to you and no one here can really advise you on anything. EULAs and the like are enforcable, but only through rl means. You'll need to ask whatever lawyer helped you draw up your legally binding EULA the best course of action. Once you hand over those files to customers, it will be difficult to control what they do with it, without taking it to rl. If you don't want to do that, you're basically up a creek. I know that's not what you wanted to hear, and it's harsh. I'm not saying I agree with it. But that is how things go in sl. There's not a whole lot of ways to ensure that someone who decides they no longer agree to your EULA actually gets rid of the files even if you did take them to rl court. I understand why you have the rules you have and I believe every business owner should be free ot have whatever rules they want. We's all free not to buy if we so choose. You're just going to be in a rough place trying to enforce it without going the legal route in some cases.
  17. I don't trust anyone that can't give me rl info of a human or preferably organization I can contact to make certain that's what funds are for and where they are going. That person or organization also needs to be able to verify for me. I don't do the "portion of all proceeds" or "all profits benefit" etc.. without that. Too many people take advantage of situations like this and many more will. Especially this time of year. Normally I'm a pretty trusting guy and I give benefit of the doubt. But this is one area, especially in sl, I am extremely cautious. I've been burned before and it was not a pleasant experience. I even got backlash for helping some fraud a couple eyars ago. I didn't know it was a fraud until after the fact, no one did. But I, and many others were named as people contributing to that cause. So it ended up looking bad for all of us, even though the rest of us did nothing wrong.

If you're asking folks to work for the group too, and you haven't already posted. I didn't look. I'm sure there are places inworld you can advertise also. I just wanted to let you know that you're going to need to create a new group. Yours will be shut down. Linden Labs doesn't take too kindly to people using the name Linden. Now's a better time than any to make a new group before yours gets big and you then have to get everyone to transfer over. It's a pain. LL won't give you warning before telling you to cease, either. They also won't change group names. You'll need to make a new one. Surprisingly, it's one offense they actually take seriously. They've even temp. banned folks for using it.

That is the issue. Someone is making money from Illegal use of copyrighted material. That is why LL clamps down so hard when there is even a sniff in the air of a DMCA being filed, as in with the Na'vi, Star Wars, Star Trek, or Dune. Exactly, it's not always a case of someone just bein mean because they can. It may be possible that a company would do it just to be mean but you shouldn't assume it from the word go. The minute someone stops covering their own ass is the minute someone is able to exploit their work. Lots of people can, do and will exploit it too. Some people don't care about that and will freely let people use it. There are some people who do care though and will do whatever they can to prevent or stop it. I know it sucks to lose something you enjoy but it's not just about you. To expect a company or anyone to see things from your perspective, you need to see it from theirs too. I have had my work ripped off. I've seen textures I made show up in sl, inworldz, on deviant art and other random web pages. I've seen my sculpts all over sl, inworldz OS grids and other places too. In some cases I don't really care, in others I do care. Sometimes it downright pisses me off. I have that right, it's my work, I own it. I don't owe anyone a damn thing, or even a reason why I don't want some of my stuff all over kingdom come. How much someone enjoys it doesn't really play a part in it, at all.You might feel the same if you'd even been put in the same situation. Or you might not. For some companies going after people is easier, they have the resources. For others it's not always nearly as easy. Sometimes it's not even worth it, which is usually the basis for why someone won't go after people. Not because that person or company loves their fan or customer base more. It's usually because the end result would cost them more than you using their stuff loses them. I'm not syaing I agree with how companies go about it or whether or not everything should be available for free use. I am just sharing a perspective you clearly cannot see. You don't have to change your opinion or be any less angry about the situation. Most people probably would be angry too. A lot of people also don't understand the why's and how's of situations like this. They just see it as some bully taking away their toys and nothing more. That's not always the case.

Do they make ONE linden from selling starships or uniforms? If not then what is there benefit from smashing us as we try to play Trek in Second L:ife? Why not take the example of Dr Who whose creators ENCOURAGE their fans to build and play by making tardises, avatars, sonic screwdrivers. Could it be because they appreciate and love their fans more? You're quite wrong to assume that I have no clue. This is not my first avatar, it's just the one I use now because of a challenge some of us merchants participated in some time back on the forums. My first avatar was a merchant from 2005 until only a few months ago. In fact I made my rl living and supported my son being a merchant in sl that entire time. I never once violated a copyright or trademark to enjoy my sl, and still don't. Most people don't. I've probably also put more money into sl than you have as well. But it doesn't matter. How much you, I or anyone else spends is irrelevant to the issue. I don't know why you think it matters. A penny is a penny, neither is worth more than the other. You seem to think you, and those with your same interests are special and should not have to follow copyrights like the rest of the world. You are wrong. Lots of companies never bother follow through when people abuse their trademarks or copyrights. Some welcome it. Some companies do care though and will pursue it. They have every right to do so, whenever they choose. It's not a callous attitude or harsh, it's just a reality. Like it or not, we all have to follow the rules. No one has to let you do anything with their property. You're not owed some right to do what you want just because. Plenty of merchants and others the world over enjoy their hobbies, interests and even business ventures without overstepping those lines.

I highly doubt people are leaving in droves. Especially people so very immersed in their RP, or hobbies. However if you're going to break copyright you have no business getting pissed off when someone catches you doing so and takes action. Be original and stay away from copyrighted materials and you won't have a problem. It's possible, thousands of residents do it every day. It's not CBS' fault that people can't use their gray matter and create their own unique content without ripping something else off. I'm sure you'll give the everyone else is doing is shpeal, but that's a crock too.

Because I've seen their type do it plenty of time to companies that are coming under attack, or scrutiny because of poor decisions they've made. I saw it not long ago at a company. All it takes it one person to get past that spam filter, to create a nuisance. It doesn't even have to be a harmful nuisance, it can simply just be annoying. Even minor annoyances can be big headaches and cause a company to rethink how they deal with incoming communication. Although it's actually not that hard to get past a spam filter to begin with, if you really want to. Don't have to be a rocket surgeon to do it.. Depends on the type of spam though, and who you're sending it to. I agree it's a great idea, and it has a lot of merit. I just don't think LL ever would, and I don't think the reason has anything to do with the potential for spam or anything like that. I think it's pure laziness on their part because it would require, or at least we'd come to expect, that such an action would make them more responsive. That's just too much work for them. Sadly. Or, I should say, they've given us no reason to believe otherwise, lately.

  24. I had a problem exactly like that a while back. Lasted for about two days, and magically fixed itself. LL never did tell me what caused it. They did tell me it wasn't a ban though. That's about all I got out of them. Its probably just some odd bug. It COULD still be a ban, and they didn't tell you, it wouldn't be the first time. I think you might still be able to log into forums when banned, just not actually USE them. But only you would know if you did something ban worthy. Unless you want to tell people your other avs name and they can go looking for you, to see if an offense might have happened. If it is a ban, they're usually temporary too, unless you've been a very very bad girl, or boy, lol.

But I'm not certain Emuna did defame him when she came here, because none of us knew who she was talking about. Had the name remained anonymous, I'm willing to bet the thread would have gone differently. Another point that sticks out to me is that LL told her to AR him. Surprisingly, as dumb as they might seem at times, they don't often say things like that unless they feel there is a need. If they felt so, then I believe Emuna had every reason to feel the same. I'ts not allowed by the rules of this forum to name people here. I guess that Emuna already knows about this rule, and that's something that also you should know^^....so Ima, that Emuna didn't name Xavier means nothing. About your surprise, anyone that have contacted at some time with LL support knows that the common response (especially regarding personal disputes) is "file a report". LL support do not act like judges, they suggest you to send a report because in this way the corresponding team (Abuse team) will investigate the issue. Emuna could have sent a report against Xavier, a whole different thing is if the abuse team would have found enough reasons as to have taken some action against Xavier's account. I know that names are not permitted here, I didn't say they were. That "you should know" sort of response is what can seperate a good discussion, from an argument. It does mean something that she did not share his name(here or elsewhere), whether it means something to you or not, I can't say, but it means something to me, which is why I said it. I didn't say you had to agree. She could have easily hinted, given enough clues for us to determine it on our own, could have shared his info outside of SL, if she so chose. But she did not. So yes, the fact that she did not reveal the other party, AT ALL, yet he did come in and reveal his own self, says something to me. I have contacted LL multiple times, and have had plenty of experience both as the person that was reporting someone and as the person somsone else reported for overstepping when I shouldn't have. Their response is NOT always to file a report. In fact in most cases, they won't respond at all when you contact them these days. But for the times they do respond, there is a form message you'll get that has links pointing out how to mute/ignore. It's NOT common to get a message back telling you to abuse report someone-that's the advice other avs will give you, when you've already done so by contacting them in the first place. LL is extremely hands off, and has been for a very long time. They don't want the work involved with an AR, like investigating it. It's the last thing they'd suggest, when a mute/ignore would suffice, unless of course there was something they thought worthy of looking into. Of course you won't know if the AR does any good, because there won't be communication beyond it. That's LL's policy, unwritten of course, but we all know it's true.
