  2. This does all sound a bit fishy, I think this may well not be a copyright issue at all or at least not solely a copyright issue. This is more likely to be a trademark violation and as such, I believe I am right in saying would not be dealt with via the DMCA process. Trademark owners have a simple choice, defend the use of their trademark vigorously or lose the rights to the trademark

Sorry Dilbert but if I was new and reading this you would be confusing me : ) Using a third party exchange doesn't add anything, you simply use them instead of Lindex, they buy your linden dollars off you just like Lindex does, your balance then appears as USD (or your chosen currency) just like it does in Lindex, and that balance is then transfered to either paypal or your bank just the same as with Lindex, the process is exactly the same its just undertaken by a company other than LL

You would have to talk to the company you went thru and see the status. There always has to be a middleman with an exchange site as Paypal do not accept payments in L$s. A quick and reliable route is via Virwox after the first couple of payments it's instant to paypal, Lindex is reliable but very slow. I havent used xchange4LS but I believe I have seen the name around for a couple of years so I would guess they are genuine.

  8. Its worth checking of course but companies often set up recurring payments even though they dont actually take the money, they get up to all sorts of tricks with your cards and accounts that you never see.

  10. As soon as I saw you had replied Sassy, I thought this is going to say **P3nis**, thanks for not letting me down. The name of our game is 'Gempandas - Nice or Naughty - which will you be?' whilst I had no problem getting this tattoed in big letters on my RL willy, I feel the diddy ones that everyone seems to use in SL just won't be up to the job. Also the vast majority of breedable owners are female : )

Ello all I am in the process of promoting my new breedable pet prior to launch, and I want to make some freebie promotional gifts, my first thought was T Shirts and baseball hats but everybody does those and lets face it, who wears a freebie T Shirt?. Does anyone have any ideas? Have you got anything for free that you actually wear? What would lend itself well to having a logo stuck on it and still look credible?. All ideas gratefully received : )
  12. Disney are notorioulsy letigious when it comes to their brand you can be sure that if you were to do this Disney WILL hunt you down. They may not have got around to everyone on the grid, but they defintely cast an occasional eye in the direction of SL. A theme park has neen closed down in the past because of this and a resident who created a Mickey Mouse soft toy as a freebie was served a cease and desist notice and had the content removed. Whilst I am peeing on your bonfire, I hope you don't mind too much if I play the devils advocate but you may want to consider what exactly you are offering here, the co owner has to spend 100s of hours of building and scripting in order to fulfill your dreams and presumably under your direction and in return he is going to get half of whats left of your donations after you have covered costs, in reality this will be a cost to him and not an income. Is a person with 'advanced knowledge of building and scripting' who can build 'anything' likely to follow this route, I would say no, not if he is also 'responsible'. One also has to ask if you have taken the ideas for content from Disney, someone else is going to build it, someone else is going to script it, and someone else is going to pay for it, what exactly is your role in this? It's great to see people coming up with ideas, SL needs entrepreneurs like you, but this particular idea probably isn't going to be a winner IMHO

I think that what required it to be taken down was LL's own policy, which I think goes further than the legal requirements. LL has gone further than the law requires in other instances, probably because their number one priority is avoiding liability and litigation expense for themselves. Filing of the DMCA absolutely requires the content to be taken down, thats the purpose of the legislation, if someone acts against me in this way, I have the right to file a counter claim and then the content is replaced, unless or until a legal action is started in support of the original DMCA. You point out that this appears to be a bluff, it may well be, there is certainly something very fishy going on with this whole story, people have posted on blogs with images of the ripped skins compared to the originals, all of these images had to have been ripped, so people speaking if defence of the apparent offended party are themsleves using copy bot techniques to make their case. People are discussing this as if it has all been decided, the person who filed the claim will still have to see through their legal action and if a genuine counter claim is made they will almost certainly lose, which could then see them facing bankruptcy, loss of their home etc, since DMCA allows a victim of an incorrect claim to sue for their losses, it seems highly unlikely they would take such a risk if they knew that they were in fact the thief in all of this. I am not accusing anyone of anything, but this story just does not add up, people should consider it for what is actually is , which is more BS SL drama, the idea that thieves are going to be making regular legal challenges in order to take ownership of other peoples work is utterly preposterous.

A couple of weeks ago I watched the award winning documentary Tallhotblonde which tells the true story of a woman who deceieved two men using FB and other social networks resulting in the murder of one of the men perpetrated by the other. The woman and one of the men were leading total fantasy lives with their online personas, deceiving each other constantly, ultimately this was discovered and led to tragedy. It struck me that had they just come to SL, they could have lead out their fantasy lives 'honestly' and no one would have minded or felt they had been lied to. Having what FB consider to be a 'real' account can be far more dangerous and far more deceptive than an account which is open about its fantasy aspect.

I did google sl curio, this is a dispute between 2 established creators and since it is still in dispute it cannot be presented as an example of a successful spurious claim, this has yet to be determined, if the complainant fails they may well be liable for the defendants loss of earnings, damage to reputation and costs, it's extremely risky even if we knew it to be completely legitimate. A similar dispute occurred a couple of years ago between Ozimals and Ameretto and in that case the complainant lost. With larger more profitable businesses we can expect these things to happen from time to time, they are still very, very rare in SL. I just can't believe that copybotters who are often children or quite young with extremely limited means and little knowledge of the world are going to start hiring a lawyers and filing false claims of copyright in their local court, , these are people who don't have a few dollars to buy an SL product, I seriously doubt that most of them are even capable of making a valid DMCA claim in the first place.

The only cost to the genuine creator would be the time it takes to complete and send the counter claim, unless he decided to sue the complainant for damages caused by the spurious claim which is allowed for under the Act
  17. They can be very dumb sometimes, Was this raised as a ticket under Marketplace>Failed Delivery? You may want to reply pointing out that the Marketplace is not a Resident-run enterprise or service. But you can expect the same email in respsonse several times before you get any joy, the people doing that job seem to have been selected for their ability to be completely and utterly pig ignorant.

I agree with Penny Apart from the architectural differences she mentions, none of the MMOs in your list allow for user created content and that is one massive difference, user created content IS SL, without it our world is empty, to draw a comparison between this and a game which you buy on a CD with contents that are set in stone is really comparing chalk and cheese.
