how do i get rid of an annoying avatar that throws me in the water and follows me everywhere how do i kick or punch him or better still club him to death

He is hoping that you will do something stupid like that. As soon as you do, he will submit an Abuse Report on you. Resist the temptation. As Mr Miyagi told us a generation ago, "Best defense -- not be there." Find a new place to enjoy SL, at least for a while. And right now, submit Abuse Reports on him. Be sure to include details and refer to specific sections of the TOS or the Community Standards that he may have violated.

BTW, if you sit down, nobody can push you. When you see that guy, sit down.
