  1. Just becuse it looks like a certain product doesnt make it ip infringmet. Useing a name brand name is. if you make products that look like harry potter items . that isnt ip infringment. but if you use the name harry potter to sell the product then it is. Before you red flag other peoples work its best find out first about IP law there is alot of gray area. some of you say well every thingin sl falls under art work cuse its all just pixels. clothes in sl some say wouldnt be compared to rl clothes as worn objects and or laws dont apply. As i see it the lindens are mianly worried about brand name infringments , just cuse your shoe looks like a nike but named differently doesnt make it infringment. if you use there logo the check mark , or nike in name then yes its a problem. A idea is not copyrightable.

It be helpfull to know what processer you have, if its a 4 core or what. but seems by what you did state, you shouldnt have the problems your haveing,. not sure if this is helpfull, for the most part im not haveing lag so much but some other problems, and maybe there related. If you bring up your task monitor,(ctrl-alt-delete) and look at the tab with your proccessor stats, see if when useing sl what % your core is running at, if its peged at 100%, might be part of the probelm. what im seeing is with the mesh veiwer 3.0 there is a bug that will cuse ,like in my case i have a 4 core, one core will peg at 100 % , this will at time crash you andproformance falls, this doesnthappen at start up of sl, what im finding out is, it will work fine as long as i dont , Use voice import (like texture) or if im veiwing more then one shared media screens at same time, regular walking building moveing around in sl doesnt seem to trigger the problem, for what im told is there was a bug in a sl plugin for the 3.0 in beta test veiwer and they created a fix for the 3.1, im guessng, they didnt add it to the 3.0 main veiwer. Like i said not sure this will help you or is anything to do with your problem , but is somehting to check out and see.

  9. IM kind of interested to hear, how many prims people are saveing with these bigger prims. For example last night i rolled up my sleves, and started redoing my 2 sims, i have 2 sims side by side. Its a business center 36 offices 4 meeting rooms and a large conference hall. There large buildings, the one build the main hallway goes from one end of sim to other,and with roads side walks and so on, No fast way to do it ,resizeing the ajusting textures, but still fun.with my first run at changeing things over still alot more to do . the one sim saved over 600 prims and there is alot left to redo re design and so forth. I can see real saveings here, then to the real saveings later when i redo the furnishings to mesh, since furnishings are the major prim useage. For me more prims means i can offer more personal prims to each renter, and or more offices to rent , more money in pocket. So , 1 how many prims have you saved ? 2 how are these larger prims effecting your land or sim,(res time,lag , ect.) 3 Are ya haven fun yet :P

Well the truth behind why i posted all this is , Im a owner of a business center in SL, One of my renters is a Lawyer and deals with IP law , the things i posted was from her website, free information, talking with her , her and other Lawyers are keeping a eye on Sl as they see it as new Ground in testing IP laws, I in no way was sujesting any point of view, other then by posting this information i thought might be of interest or spawn some debate. This Forum been full of what we think IP is or means, As a creator myself this all is of interests, Knowing what the Law says may help in cases where your product gets flagged for a unjest reason, other then taken it in the chin.
  11. was wondering if any one else is haven this problem the mian veiwer runs evenly across my 4 core processer, but with the 3.0 in short order will pegg 100 % on one then ill notice performace degrade. lindens had this problem before with older veiwers , and i had to replace my processer .
  12. What is Intellectual Property Law ? Intellectual property is something that you own (your property), which you create with your own mind—your own intellect. It is an intangible ownership interest, not like real property, such as real estate. A bundle of rights, which include copyrights, trademarks, patents, trade secrets, & right of publicity. Think of a shopping cart filled with fruit. You have apples, oranges, bananas, grapes, and kiwis. While all of those items are fruit, each is a distinctly different type pf fruit. A kiwi tastes different than an apple, and an orange has a different look and feel from a banana. Yet, they are all fruit. Think of IP the same way. You have 5 distinctly different types of property rights, but they all protect your intellectual property. Here's a quick overview of what each right protects: COPYRIGHT Law A legal form of protection for an “original” work of art that has been reduced to a “tangible” form. Works, which can be protected by a copyright include books (including eBooks), articles, software, downloadable products, web content, video, speeches, visual art work, motion pictures, and CDs. What can not be protected by copyright are ideas, plain facts, material with no original content, book titles, names, phrases, slogans, procedures included in copyrighted work, material without the notice symbol published before March 1, 1989, and anything in the public domain. TRADEMARK Law A word, logo, design, phrase, sound, fragrance, or a combination of those items, which identifies the source of products and/or services. Trademarks provide both access to, and protection from a vendor, by making it easy for a consumer to know where to go if they want to purchase a product, or who to call in the event of a problem. Some examples of protectable trademarks are Golden Arches for McDonalds, APPLE for computers, Microsoft for computer software, Windows for operating systems, & the Law & Order theme song.  PATENT Law A property right granted to the inventor of a new or useful invention or improvement to an existing invention. Patent protection allows the inventor to exclude anyone from making, using, or selling the item. Examples of items protected by patent are pharmaceuticals, software, plant strains, formulas, & technology products. TRADE SECRET Law Any confidential information about a product or service, which gives someone an economic advantage over their competitors. An example of a trade secret is the formula for Coca-Cola. Know one, except those with a need to know, knows what it is. One major distinction between a trade secret and a patent is that the patent application requires the extensive disclosure of information, so nothing is secret. A trade secret, on the otherhand, allows the owner of the trade secret to maintain the secrecy of their proprietary information. Several years ago, Microsoft did what some thought to be an unthinkable act--it changed its business model to become more of an open-source company, whereby converting some of its trade secrets to patents. A business judgment decision every company gets to make. RIGHT OF PUBLICITY Law A right granted to an individual to control and profit from the commercial use of their name, image, likeness, or persona (identity). This means you can make money from your own image. What you cannot do is make money by exploiting someone else's image, without their permission. One way this arises is at conferences where meeting want to videotape celebrity keynoters, or where speakers want to videotape their audience members. In order to do so, you absolutely must get there permission.

I agree to some degree with you yes. but my qestion is what does the Law say about SL clothes. it is something worn like real life clothes. whats the difference.if your creating clothes for a avatar to wear as clothes fashion wear, this is not a product of art, its fashion, i dought the law will labal every thing in SL as art, highly doughtfull. i feel the days ahead of us will redefind IP in SL .
  14. I should have posted this on a other forum but as this is where most might find this most Interesting. The Law is NOT Fair to Clothing Designers. Sometimes justice is served—the guilty and/or liable party is made to pay for the wrongs they’ve done. And sometimes, the law is just NOT fair, particularly when it comes to protecting the rights of creative content in whatever form it may take. All too often it seems like the law protects the thief—the copyright infringer. Many people believe that copyright infringers are allowed to make money off of someone else’s creative content—with the blessing of the law. Fashion designs fall within that category. Copyright Protection. A copyright is a legal form of protection granted to an original work of art or authorship, which has been reduced to a tangible, fixed format. Examples of items that can be protected by copyright are books, articles, website content, photos, blog posts, sculptures, architectural designs, and even ship hulls. Yet, while a ship’s hull can be protected, an original fashion design cannot. To some people that is seen as a flagrant injustice. Fashion Designer Loses to Copyright Infringer. In a recent case, the designer and manufacturer of a prom dress sued its competitor for copyright infringement, and the case was dismissed in favor of the alleged copyright infringer. The court’s decision provides useful information for any young and creative designer, who wants to protect their fashion designs. The court said that the prom dress designer failed to show that “the artistic elements of its dress design are physically and conceptually separable from their utilitarian function and thus are protected by copyright.” There is legislation in the works, which will hopefully change the law, but we are not there yet. So what does this mean for you—the fashion designer? 1. Separate design elements from the functionality. When designing fashions that you want to protect by copyright, make sure the artistic and creative elements of your designs are not tied to the functional elements. Add your creative touch to the non-functional or unnecessary parts of the design. 2. Consult with a copyright attorney early, and throughout your design process, to ensure that after you’ve invested hard work and money, no one steals your content without paying you for it.

  18. I think most of you are missing the point, any use of any logo or name of a real lfie company isnt a good idea. At this time SL is still small, the(at any given moment)amount of people in sl,isnt suportive of product placement from big companies,(not worth there time as of yet), but there out there watching,and alot of bigger companies came then left,knowing the time wasnt right yet. or population. We creators in SL have a small window of time here, we dont have to compet with million dollor companies,im sure we have a few more year, but they will come and they will bring there owen designers, take levi jeans for example, they can pay some person,right out of grafx's school to sit in a office and create jeans for sale in sl they have access to take high rez refernce picture of all there jeans, this is product placement,. Now we can have our owen brands yes some might be better then some of the name brands out there, this is the time to make our own brands and get your names out there as gifted creators, maybe some can be hired to create for comeing companies. The point is , you might get by useing a name of a prodcut for a while but if that company comes to sl then,where are you at???? you will have to remove all your products, maybe even pay back profits, lindens have been trying to get us to see this. In time all social media, from tv to google,product placement (ad's)is a big thing,sl will be no different,Dont belive we have this sl world to our selfs as a playground,

The gun itself, should be a problem, its how you name it, it you use ak47,or reference to it being like a ak47 then your useing that name to sell your creation, There isnt anything new under the sun anymore, and impossible to create anything ,that might not look like somehtinnng in the real world, this is a big gray area, rule of thumb, dont use any part or hole parts of any well known names,or logo's, and if you do follow a style of a certain product for example sake's, just add a little somehting to make a little different and personalized.

OK i understand mesh needs extra time on test sims on main grid, but why hold back the increase in prim size till mesh is 100% mian grid,mesh is proveing to be limited and still needs work on the details, the prim size thing should be a issue, there is many of us that can work on and redo current projects to reduce prim usagestart delayed projects, that have nothing to do with mesh. Right now you cant take a mesh object from test sims and bring to other parts of sl, but you can with prims sized bigger,so the only thing stopping us from useing them is some code being activated.
  22. I myself have been seeing this same problem, when i look at somehting and zoom in the look flips back at myself, this seems just in the last few weeks ,this started. your not alone. As for the veiwer 2 ,well veiwer 1.25 will be gone soon as mesh is released, so lets work on fixing V2 bugs , older veiwer is the past.

This exponential improvement has dramatically enhanced the impact of digital electronics in nearly every segment of the world economy.[4] Moore's law describes a driving force of technological and social change in the late 20th and early 21st centuries.[5][6] Guess Lindens haven't heard of this Law . they have there own law Called the Law of 15,000 prim limit per sim. this law of theres, insures no one will ever be happy with 512 plot and will force the never ending upgradeing of land. there main sorce of income. 8years we have had the 15,000 prim limit, do you really feel this is a wall that cant be crossed ? lest not by choice on there count. Mesh is like a round peg being driven in a square hole, by trying to make it work under this linden law of 15,000.

  25. Well all i can say is about **** time . and my hat off to the lindens for working with the pressure of the masses and getting this done. I think, most of those that complain about mesh , do so becuse change is hard, or the tipping of power ,some may have on the markets. When i started sl there was only 10 sims, only 100's of people and mostly just sand every where you looked , a hand full of scripts ,only clothes we had was what the lindens provided, the old hair , no prim hair at that time, no anamation,you couldnt buy money then , no markets of any kind,nothing that we have now, people worked togther alot ,we traded are works, each time somehting new come along it would upset the balance of thing, and as allways new thing spawned different area's to thrive in, in a nut shell here, you dont want to go back, sl has gotten better, and mesh will(and somehting i been waitng for longer then most of you have)make sl better, to me, this will clear the playing feild, those that dominate the markets now will also have to learn mesh,every one has a chance, not every one will or can do mesh or make the change,but every one has the chance on a even playing feild to try,life will seek a balance again, the people that made the sl we see today where creative people there works inspired others each building on idea's and works of art in thereown minds, i hope mesh brings that back to sl , new life,
