Question

have found a vender ..

 

 

 

on market place whos been using copyrighten mesh models ,selling them on the market place.as is.

been trying to report her, for it,shes done this alot for long time, and its making it harder on us who acrualy do make our stuff..

Generally it's a normal human attempt to warn others, about people doing something wrong.
But naming them in public (like in this forum) can bring you into a lot trouble yourself.

in this certain case the object is from a share CG page, which means you personally have no way of knowing if the person in question legally bought this object and thus holds certain rights to use and resell it. It says non commercial use only, but he/she could have made a deal with the creator - as far as you could know.

If anything will be done against it is another question. Because only the copyright owner / IPR owner is capabale of taking legal actions against such a person.

In this case it is apparently clear who the original creator is, so it's best to send them a note about this too. And leave all further actions in his hands.


However, Linden lab is capable of banning accounts which have broken the TOS with valid proof.

You can't file a complaint.  The copyright or tradmark holder is the only one who can.  See http://secondlife.com/corporate/dmca.php and http://wiki.secondlife.com/wiki/Linden_Lab_Official:Intellectual_Property .  Some RL business, like Disney, are vigilant about watching for copyright infringement.  Most others are not, so many possible cases of copyright infringement in SL go unnoticed by the rightful owners of the intellectual property.

And yes, you should remove the name of the suspected violator from your post immediately.  You are violating the community standards of the forums and could be ejected, and you could become the subject of a defamation lawsuit in RL.

yes you should remove the name because this is Q&A topic not owned or managed by Linden Lab however i would suggest to stop reporting people like that. Mesh objects can be made by the same person. in other communitys and then upload it here too. i don't think that is a copyright issue.
