That's really a hard question to answer.  Many people close their inworld stores but maintain a marketplace store.  And sometimes people just abandon SL and forget to shutdown their marketplace shop.  If you are concerned, contact the shop owner via IM or a notecard.  If you do not get a response then you might not want to purchase from the person.

Welcome to Second Life Answers, Nisha.

Even if a person is banned from Second Life, often their Marketplace store remains open.  As the owner of the store does not actually have to physically box up and send any of their items to the buyers, it is all done automatically once you click to pay, generally speaking, it is safe to continue to purchase from them from the Marketplace.

However, sometimes items can get "lost in transit", and buyers need to send notecards to sellers to request redelivery.  Only you can decide if it is worth the risk of purchasing from a store whose owner may no longer be available for after-sales service.
