  1. Lol once a banker always a banker eh. I hadn't done the calculation but it doesn't seem a good return. I cash out monthly as I have no urgency for the cash, so less impact for me.
  2. That's not very constructive, what would you suggest she does? I'm not one to recite TOS so I'm unsure what the rules are around relisting, but she did say she relisted items she had worked on, I can't really see what other option she has. If she has correct the items and complied as best she can, why can't she relist. Sorry this happened to you Casandra I hope you resolve this soon.
  3. Hi Ashtyn, firstly I’m really sorry for your troubles and I hope you sort it out very soon. Out of curiosity how did you get the name of the person who filed against you? I’ve had a similar experience and the notification did not name the filer, it said “ Linden Lab has received notification from a copyright owner, or its authorized agent” So I’m wondering how you knew who filed? Even when I successfully counterfiled I still didn't get any documentation with the name of who filed, so I'm very curious

If your "personal reasons" relate to the guy you labeled a thief for making a sofa similar to yours then I think you might find it's not easy to copyright a sofa, it has something to do with 'useful function'. But I'm not a lawyer so I wouldn't assume to know for sure. I do know that I have been shopping for a new sofa myself in RL and the similarity between designers and different stores is indeed substantial, but I don't see them taking each other to court. Also in reference to something being copied or modified beyond recognition, if it can't be recognised then it's not a copy and no one is even going to bother making a comparison because they'd never know, isn't that inspiration.
  5. I’m not entirely sure what impact ratings have on ranking if any. But I tend to agree with you, I think it’s strange that merchants essentially bribe their customers to write reviews by offering such incentives. I prefer my reviews to be on merit of the product. What I’ve also seen is the offering of freebies/gifts in exchange for a review, the merchants products are listed at a very low price, freebies given out, then once there is a ton of reviews the prices goes up. I’ve seen one designer do this over and over, freebies offered, prices goes down, reviews are written, price goes up again. She also uses the same technque but as a raffle/draw type scenario, so obviously anyone writing a bad review is not likely to win.
  6. I think you need to be very careful. If it's an exact copy, prim for prim same dimensions, rotations etc, then it could still be considered a breach of copyright. If it's something similar then probably not, there is nothing wrong with taking inspiration, provided you add value and make it your own. Obviously you can’t copyright a ponytail, any more than you can copyright a wall, but you possibly could copyright certain formations, I don’t know for sure. I don't sell things made by other people; if you’re selling items you didn't make you should be very careful about the source, unless you made it yourself you can't really be certain.
  7. Well if that's the case and your items are stolen, you're not going to get them reinstated as the DMCA would be perfectly valid.
  8. Yes the DMCA process is truly awful. I received a DMCA against several of my designs, I counter filed, after 10days I had to contact the IP team myself and remind them to reinstate my listings. Not only that, I also had to counter twice, because they didn't receive my counter the first time, delaying the process even further. The best way to do this is to reply to the original email you were sent from the IP team informing you "a copyright holder" has filed againt you. Let them know the 10 working days are up and unless they have received documentation from the filer saying they're taking you to court, they must relist your items. Unfortunately they probably have to deal with a lot of frivolous filings so a gentle reminder should alert them to your case. Good luck with this, I know how upsetting it is 
  9. I didn't make folders, I placed boxed items into the merchant outbox and sent it to the Market Place, I had no problems with it at all. I build prefabs, so it shouldn't be an issue for the customer as they will require land to rezz anyway. But I imagine it could be laboring for those who design items such as clothing. But in summary it doesn't require you make a folder for everything you want to transfer, you can leave it boxed

  12. Personally I prefer to re deliver to my customers myself. I find I don't have that many non deliveries, I generally log in daily and in the interest of customer service I'd prefer to deal with these issues myself. I believe I handle it quicker than the customer relying on LL to respond to a ticket which could take days. Raising a ticket is an inconvenience to my customers and it's possible a lot of residents probably don't know how to do that. It's part of being a merchant, it goes with the territory
  13. The process is very one sided, I have just been through this. I had DMCA filed against some of my designs and I counter filed it, you can give a PO Box, which I did. When you get the DMCA takedown from LL, it is an email from the IP team, it tells you nothing about who filed or for what. It simply says a complaint from "A copyright owner". When you counter file, you give full disclosure of all your personal info, name, address, email and phone number. As soon as you counter file, LL will forward your document with all your info to the person who filed against you, you still receive NOTHING about the person who filed. They then have all your info, you know nothing about them. They then have 10 working days to forward documentation of court proceedings to LL, or your items are restored. I guess you would receive their details if they intended to take you to court. In my case my items were restored to the market place as there was no validity to the claims The whole process is very intimating and upsetting, it seems very unfair that the only way to get your items restored is reveal all your personal information to a stranger. But that's the way the process works, so setting up a business address and name is a very good option. I also understand you can have a legal representative file on your behave.
  14. I had exactly the same situation, my Alt account was exposed via a notice to a group of 200+ it was done deliberately and with nasty intent,not by accident. I AR’d gave the date and a copy of the notice, to my knowledge nothing happened. Even worse, there is not one person that knew my alternative account, just me and LL, so there is more than one privacy issue at stake in this situation. This person is either using illegal tools or has affiliations, in this case it’s likely the latter.
