Illegal machines sold in the marketplace

My boyfriend and I recently purchased some machines from the marketplace, for his land. Some of them are:

Someone told me they are illegal. Can anyone please confirm or deny this? If they are indeed illegal, I want to know how they are allowed to be sold in the marketplace and how I go about to report the seller and get our payment back.

Because they were there BEFORE LL introduced the new rules and there was no requirement (or thought) to remove them.

I'll bet that LL fob you off with "Resident to resident issue".

While basking in the commission that they just took selling games that are disallowed under their own rules.

Nobody has said that, you have been given a link to the current gaming policy, the suggestion is that you read and understand the content of that text.  There has been far too much discussion in various threads about it, there's no point asking for legal council here.

Yep. Just like rl guns.

Except, rather than just being banned, you could get the chair if you use them to do something illegal.

The point is, Linden being aware of the sale of these machines in the marketplace and not taking them down or forcing creators to modify me is intriguing...

 

I came to learn of this policy only when we asked someone in a casino to put a machine in his land. They were purchased innocently and the comments in many make reference to the easy way to make a little income. And nobody is banned...

Because there was never a sweep or any coherent LL plan to remove them from MP.

The problem with MP is that it's very badly managed.  I've just looked through someones store, 286 pages (I didn't see all) with the same generic keywords for just about every item where only one keyword changed and that was the product title.  Irrelevant since title is already searchable.

Is anyone going to flag all 3000+ items for keyword spamming?  No.

Just as the seller may have left, given up bothering etc. so unless there's a positive sweep by LL, products will just sit dormant on MP.

I've regularly asked that there be a requirement from merchants to "touch" each listing in some way, to re-activate a listing and keep it alive, this way old stale things with dead merchants would fall away.

LL did tell you about it.  It was blogged about and that blog entry would have appeared on your dashboard. It isn't their fault you don't pay attention.  Do you expect them to IM you personally?  It is your responsibility to keep up with published changes like this.

Granted it would have been nice if LL had removed them from the MP, but the TOS makes it clear that you buy under a "buyer beware" policy.

Have you contacted the seller and asked for a refund?  Did you flag the items in the MP?
