Someone used my art on a listing for a product and I want it removed, but he's not "selling it."

This listing https://marketplace.secondlife.com/p/Soul-Reaver-Sword-FULL-PERMS/3246346?id=3246346&slug=Soul-Reaver-Sword-FULL-PERMS is selling an in-game copy of the Soul Reaver sword from the Legacy of Kain games.  I'm quite sure that he doesn't have permission from Square Enix to sell their trademarked intellictual property.

 

What I am posting about is the two small circular symbols on the bottom of the image for the sword he's selling.  Those are the photographs of the brooches that I made years ago in college.  You can find them http://fanatical-chick.deviantart.com/art/Legacy-of-Kain-cape-brooch-2-32883847 here and http://fanatical-chick.deviantart.com/art/Razielim-Emblem-17886193 here.  I don't care what happens with the listing itself, because I can't legally claim copyright on the Soul Reaver, but I made those two brooches, so I have the rights to those two items, and I have never given anyone permission to use them in anything, especially not to make money from.

 

I would like the image to be changed so that my brooches are not used to promote his in-game, for-profit item.  I have already sent him a message through facebook, the only way I could see to contact him, and have given him a few days to reply.  He has not yet replied, and so I felt it best to go to SL to report it directly.  Due to the complicated nature of the infringement, I didn't know whether I should file a formal written copyright notice through mail or if there were something else that needed to be done.

That's exactly what you have to do.  See here for instructions about how to file a formal DMCA complaint.  When Linden Lab receives a valid complaint, federal law requires them to remove the product from their site.

While the others handle DMCA advice I'll say that, though I'm not a gamer, your brooches are nice. It's been ages since I worked with anything smaller than the parts I weld back onto my tractor after they fall off.
