I will probably regret poking my nose into all but ... it's a big nose! Menhue, good luck stopping anybody from doing business with you as a punishment, on the Marketplace. Perhaps it's a small point to make, but the discussion was about SL and you claim it's one way to make them worse off.

I have to be honest and say that I don't really care for the money, but I do want more **bleep** than Frank Sinatra. Back on topic ... I don't see any mention in the TOS where LL says they will pay me for whatever money they make from me. Maybe you can point me to the section that states that? Because they sure as hell state they can use whatever I give them in any way they want. I just don't have the faiththat we will both get rich like IBM and MS in your previous post. -

This is perhaps what a lot of people don't seem to understand about this new TOS. It is not just about porting your prims and textures over, it is about being able to use your ideas and change them however they want too. They can: "use, copy, record, distribute, reproduce, disclose, sell, re-sell, sublicense (through multiple levels), modify, display, publicly perform, transmit, publish, broadcast, translate, make derivative works of, and otherwise exploit in any manner whatsoever, all or any portion of your User Content (and derivative works thereof), for any purpose whatsoever in all formats, on or through any media, software, formula, or medium now known or hereafter developed, and with any technology or devices now known or hereafter developed". (From Section 2.3) Bolded to make sure some people see it lol -

I don't know how this is going to pan out in the longer term, and I have to admit that I don't really believe it will get anywhere near a count of law to be proved one way or the other, but what I find fascinating over the years I have been around this forum is, how little by little, one at a time, people who once waved LL's flag have gone to the other side, one less for the Empire, and one more for the Rebellion. *Wookie roar!* -
I am no political commentator, but what if the recent US crisis to get the nation's debt limit increased and end the shutdown led to some of this quietness? Maybe people are waiting for a deal to be struck and the US to get back to 'normal' and be paid for the jobs they do, and decided to cut back a bit from 'luxury' spending in SL. Hmm, who knows? As for me, I have seen no noticeaboe change in SL whatsoever.

I will just paste over what I said in another thread, and then add a few more thoughts for discussion One point I think a lot of people are missing, when it comes to how useless SL content will be in other games etc, is ... it's not just about the prims, it's about designs. LL has the right to it ALL, not just prims, scripts, textures, but if any of those elements do not work well in aother grid/game? Copy the idea, the design. Sometimes that is more valuable that the actual setup already present. Could be with a piece of clothing, shoes, hair, vehicle, avatar, whatever. If the prim doesn't port over, copy the idea onto a prim that does port. Also, what about the question of alts? If I have an alt, one with a shop and one without, and I only log in to the alt without the shop, I am agreeing to the TOS, and I would think in the eyes of the law, it doesnt matter if I am on an alt or not - I am the same person. Then we have the issue of lack of warning. What if I was just about to finish a big custom job, and was just about to upload the work, then BOOM new TOS.If you log in, you hand your rights to LL. You may have no way to inform the client without using SL, and they may have already given payment or a down-payment. There goes your reputation as an honest creator! Then there is basic customer support. If by any chance a product ceass to work (for example, as has happened, by a server side update, which has broken scripts), you have no way to not accept the TOS and also be able ot log in to fix your stuff. Again, you may end up with unhappy customers, but then again, you may never come back to SL because of the TOS anyway .. hmm. -
Aww Drakey-poos, welcome to the merchants forum. Don't mind the big boys here, they can push hard, but nowhere in your posts did you mention helping new residents with the figures, so don't hide behind that when you are called a troll. I dont care about intent, and like Medhue says, I make money here and they can pull the plug on this any time they like, so why not continue doing what we have been doing? Durrr! It's obvious! First you mention hard wood and soft wood (hehe!) Then you got a reference to sea men (har har!) And near the end, you talk about a recessed space (ho ho ho!) I didn't get where I am today without knowing about these things!

Why are "DEMO" items counted as "FREEBIES" on Marketplace?

This is not an exploit, it's a failure of the system to provide proper classifications and categories. Merchants would willingly put their demos in a 'demo' category but we don't have one, so it all gets lumped together in 'Freebies' Before you go reporting, why don't you try to get LL to listen to you, that's what we have been doing for years now, with little result. (For example, we wanted email notification of ratings and reviews made, but we got a Facebook Like button instead. This is how most marketplace requests by merchants turn out. We did get the email in the end, but after a very long time). -

It seems it's all very confusing, or rather, LL wins either way. If we agree, and log in, we let them take the rights.We can argue further if this means at all times, or only after the new TOS. If we do not agree, we cannot log in, and the items we have uploaded cannot be deleted from our inventories and we cannot delete our prims and close our stores until the rent runs out, unless we have offline contact with the landowner. At least, that's how it seems to me. -

If we had to agree to this new TOS before we logged in (which we did) then goodbye rights, they are gone, and I think I am safe in saying that nothing can be done to legally reclain these rights. You agreed, deal with it. Hoewever, the interesting question for me is, this new TOS cannot possibly apply before it was implemented, which means, you do not lose your rights to content uploaded before the new TOS in August. I just wonder if LL have good records of when things were uploaded so they can cover their backs. -

You arent the only one. The other day I was on the Home page and I saw one of my items go past. I thought I was dreaming, because I cancelled all of them a few months ago. But there it was ... still not helping to increase sales LOL.

Wade, i think someone may have said 60 days once, but it might just be a feeling I have, no evidence. I don't mind a month, it will make me move my bottom to get it done, but I noticed I have different names on MP listings and different names on my boxes in-world, so I bit myself in the butski there, didnt i? haha

It happens, you cant please everybody. I am sore about reviews because when the marketplace transitioned from the old Xstreet, I found several of my items had 'hidden' 1 star ratings (I cant even call them reviews because they are only stars, no comments), that were suddenly made visible. In the Xstreet days, it took 3 ratings to make it all visible, so one or two ratings were hidden. The Marketplace made them all visible at once, and now I have absolutely no idea who gave the ratings, and there are no comments to go with them to tell me why. I cannot do anything about these ratings and they will stay on my items until the end of time, for an unknown reason and by unknown customers.
