Melonie Romano Posted January 22, 2012 Share Posted January 22, 2012 I make animations, and noticed under mod copy trans user license crossed out in marketplace...does anyone know what this means? I'm unsure about licenses. Can I get a license for my store name so no one else can use it, can i have a license for my products? I do have a form I use for full permission animations that I use, that i found from another animator for full perm license. This of course costs money and is not cheap. So you should consider if the money spent on trademarking your name is worth it. Also the name may already be trademarked, and if it is you can't legally use it yourself. You can search the US trademark database here to see if it is all ready trademarked and you can legally use it. The product license itself is something you write detailing how your full perm animations can be used. Some creators consult a lawyer specializing in IP rights before deciding what restrictions they wish to put in their license. Common clauses for full perm items are The item must be either copy or transfer, not both, when passed or sold to another person other than the purchaser and the item cannot be sold as a stand alone product but must be part of a larger project. You may put any restrictions you want in your license, however be aware that the more restrictions you place on your products, the less you will probably sell. When User License is crossed out in a listing on Marketplace, that means there is no user license other than the simple standard mod/copy/transfer permissions given and what the IP rights under the TOS state. You should review that part of the TOS as well as the official corporate policy for IP enforcements here as they apply to the purchasers of your products as well as your use of the name you've chosen and how you sell your items. If you choose to have a user license the full license should be stated in your listing so people know prior to purchase what restrictions your placing on your items. If a name is already registered, you can still register it if your use is not similar to the use for which it is registered. If the license terms are not fully disclosed before the sale, the license will not be binding on the buyer; the license is just a contract between the buyer and seller, and if the buyer pays without having agreed, the seller can't enforce it, i.e., can't change the terms after the sale.
