If you truly want this to be resolved peaceably then why are you seeking solutions now before your neighbor has had a chance to respond??   Sounds like you have no trust in people.

Send them a polite notecard explaining the problem (as I think you've done but if it was an IM then a notecard would be better in case your neighbor's IM's get capped).  Give it time.  And don't jump to conclusions about the new neighbor intentionally trying to disrupt your SL with particles........it's much more likely that they are simply not aware of the issues they are causing you.  If all else fails (as a last resort after exhausting polite notes or chats) you can file an Abuse Report and have LL take care of it for you.

That is annoying.  While you wait for an answer, you can turn off particles by typing CTRL + Shift + Alt + = .  That will turn off any particles, including your own, of course, but at least you won't see our neighbor's particle show all the time.

If IMs are capped, then so are notecards, group notices, group invitations, and inventory offers. They all fall under the same cap.
