May i name my store after a RL brand name?

Just wondering if its allowed to name a clothing store in SL after a RL brand name for noodles, soup or whatever.

I know it would be silly to call it "coca-cola", but how about other not-so-popular names?

Theres alot of nice brand names for food, snacks ect. so i'm just wondering if i could get in trouble if i would give my clothing store in SL one of these names? Does anyone know?

Best thing to do is to try your best to come up with your own name. It's not easy. I made my company name "Anthro Planet" then turned out that's some sort of comic or some crap. So I had to change it to Anthro Planet Incorporated. Taking a direct copy from something is protected by copyright law. But copyright law also says you can not take the original style of the item you are interested in. As long as the name or item is not a direct copy of the original it's not violating copyright law.

You have to create an original name.

Yes, you can get in trouble for using another company's logo, trademark or brand name. (without written permission from that company)

Danicah's would make a good name for a store. Sounds nice.

For most of those names, you'll have copyright issues. The company has gotten a copyright to that name, and will often aggressively persue anyone who wants to use it. That's why they got the copyright. Try to come up with your own name, or consult friends, or even ask here on the forums for suggestions, but don't use an established brand name, popular or not.

I would avoid using a sl name, as anyone could reuse it, or if someone has a version of your name with a differnt name, could cause further confusion. Myself, I used ghost jewelry, after doing a search in sl marketplace for ghost, and found not much that use it, so felt safe.  Depending on what your doing, do   (Subject of what your selling)+(Action or high value word)+(random business or hipster word)=store brand   or get clever and use a anagram for your store logo name

You don't have to change the name of the store, but I'm feeding the text "Skins by Danicah" to the Google spiders to point people at a link to your store.

It should take at least a day or two for the spiders to bite. So, if you don't like it I can delete the page right away.

Here's Google search for "Skins by Danicah". If you make it "skin" and/or "danica", it's still OK, so it looks like you'd be in the clear.

It's a trademark issue.  Go to  this website  uspto.gov and search for the trademark names you are hoping to use. Read what they have trademarked it for ... and don't use it for the same things.

EXAMPLE: "Baja Fresh" is a chain of fast food mexican grills.

I look them up and see this:

Goods and Services IC 043. US 100 101. G & S: restaurant services. FIRST USE: 20080814. FIRST USE IN COMMERCE: 20080814  

So, if I want to do a line of beach clothing, I'm OK. Anything food-related would be not OK.

 

If they had also trademarked it for a line of clothing, I couldn't use it for clothing.

ok, thanks for your answers. Lets say i am thinking of a unique and short name...

How will i know if that name isn't already taken as a brand name somewhere in the world?

Might be possible that there is a swedish pet food, or a malaysian hair dye with the same name? How will i know?

Something REALLY obscure, you don't have to worry about quite as much. You should try for something unique, of course, but that is quite difficult to manage.

First step is to google the name (or use any other search engine you prefer) and see what, if any, results come up. If nothing does, you're doing pretty well. Then I'd probably go ahead and double check by putting into search in the SL marketplace, to make sure no one in SL has already claimed it.

If you get no close results either way, go for it! Keep in mind that for one thing, a very small company (like a Swedish pet food company) might not even see it. Doesn't mean you can KNOWINGLY take that name, but if nothing comes up in search, you're acting in good faith that there is no brand by the name you chose. Also keep in mind that not all names have been copyrighted. Your biggest concern is not necessarily the name, although again you do want to be unique, but the copyright.

I'd say a google search and a marketplace search should be enough, realistically speaking.
