legal question bout Nudity photos

im looking to start a magazine in SL, a type such as the Nudity magazines in rl, tasteful nude photos, or skimpy clothing, and im jus wondering if anyone has any idea on the legal situation for that.

 

a friend told me it would be considered pornography since they are nude and could be illegal since theres no way to verify the people are over 18 in rl, but does it still apply since it would be taken on a ADULT sim and its a avatar?

 

i mean im a bit lost on it because it wouldnt be a rounchy nude magazine, it would be tastefully done with articles about the ladys and men and info where you can see them work as a dancer or whatever.and the maganize would only be distributed through Adult sims and Adult clubs

 

so my question is, if they have to access a adult sim to take the nude photo that i would distribute in a magazine, can i get in trouble for that?

A magazine with nudity is probably not a very good idea since the SL main grid now has minors legally here.  There's a problem with exposing minors (in SL the 16 and 17 year olds in real life) to anything that can be construed as pornographic (I'm not going to get into what is or is not pornographic...........that's just to much subject to individual interpetation).  You can display the images (I assume these are real photographs or videos of real people) on sims that are set to "age verified" and adult only.  But making a magazine that can be taken into someone's inventory and shown to anyone is really setting yourself up to some potential problems with LL..........possibly up to a permenant ban from SL.

 

There used to be lots of magazines that were adult oriented in SL but that came to a screeching halt when LL opened the main grid to 16 and 17 year olds early this year.  I wouldn't chance it myself.

I think Peggy hit on the key point, but I'm not sure there's not a way around it.  The mobility of the magazine is the issue, i.e. the ability to take the magazine into inventory and share it outside of an adult sim.  So hypothetically, I do a gallery that is nothing more than the pages of your magazine displayed on a wall in an adult sim for people to read and view.  In my mind, that is allowable under the current rules.  Only adults can view it, since only adults can access an adult sim (ignoring the obvious age verification issues) 

So if the magazine was non-transferable, wouldn't that remove its mobility??  Problem there is stagnate distribution as in who's going to buy it?  If you are creating the magazine as a vehicle to sell advertising, then you want people to give it to their friends.  So while no transfer seems to solve the mobility problem, you have a dead end distribution model.

There have been a number of Playboy-style SL publications and also a few hardcore magazines. They come and go. (I've advertised in one of them, and another one featured an interview with me back when my items were more popular).

Anyway, Immy is right that you don't need to worry about legalities as long as you sell your magazine on adult land or mark it as adult on the Marketplace.

Peggy's point is moot because it applies to all adult items in SL, some of which are a lot more controversial than a polygon porn mag :) People might as well rez BDSM furniture or wear prim genitals in PG areas, there is nothing we can do about that. It's LL's job to make sure that only adults get into adult areas and have access to adult Marketplace listings, and that these adults don't rez naughty content in places with a G or M rating.
