Is it against the TOS to make permission to share chat logs a condition of joining a rp sim?

No, it's not against the TOS.  If you look at the Community Standards, which are referenced in the TOS, you find

Remotely monitoring conversations in Second Life, posting conversation logs, or sharing conversation logs without the participants' consent are all prohibited.

If the participants have all consented, then there is no violation.  As you said, if a person doesn't want to agree to the RP group's conditions, they don't get to join the group.  If they DO join the group, you can assume that they have read and agreed to the conditions.

This topic has been beat to death over the years and from my perspective the best answer is to use a non-Linden Lab site such as Yahoo Messager to share chat logs for such purposes.  The TOS states that you cannot share those logs within the boundries that LL controls.  Their Terms of Service don't apply beyond Second Life. 

So I would still make it clear to all involved in the role play that chat logs will be used to settle disputes but also that those chat logs will never be shared inworld.
