Tier is basically how much land you can have at a certain level.

If you are allowed 2253 sqm of land at your current tier level you can have anywhere from 0 to 2253 sq meters of land. Once you own more land than that, you have put yourself into the next tier level.

So, your tier level is how much land you can own, not how much you have to own, so no Linden Lab will not punish you for not having all the land available to you at your tier level.

I believe your question arose from this article:

http://wiki.secondlife.com/wiki/Help:Groups_and_Land

What that is saying is that if the group has tier donated to it, but then a group member takes back their donation and in effect leaves the group owning more land than it can support, then Linden Lab will take some of the land until it is in compliance after a 7 day grace period.

I know, very confusing.

If your partner wants to pay $15 a month for the 2048sqm tier level & have the land deeded to a group, she will be able to own 2832sqm of land. This is calculated as below:

2048    $15 tier fee (2048sqm tier level)

512      Premium membership (512 tier free allowance,  provided you have NOT used it for a Linden home)

272      10% group land bonus (For having all the land deeded to a group)

-------

2832sqm

You can own anything up to that amount, but no more, without going up to the next tier level (which is $25 a month).
