I was wanting to put a statue of a loved one, in my garden but everything i have found so far basically requires them to permanently be sitting on the stand , is their any way around this?

There's a way to fake it. You can take an image of them (even with marble skin and statue-y clothing), and use it as a particle image. Emit one every 59 seconds, and set its lifetime to 60 seconds.

It'll always face the viewer, but hey. It's one way people can simulate making a statue of someone they know.

Maybe there is an AI program on the web that can make a 3d model from photos. It may not be the best 3d model but it's a statue so imperfections wouldn't be unusual.

You'd need some sort of virtual 3d scanning app and then the output put into blender to convert to a dae file. A friend coded such an app and has made some statues of me but on another grid. I'm not sure she has uploaded it to SL but I'll ask when I see her.

An example is this with 4 statues she made of me to test it.
