Question

Hi everyone, sorry for sounding a little confused but i have been creating a little bit of stuff and put my items on Marketplace but i don't make my own meshes,i purchase full perm items. My question is for most part the items full perm terms are simple but i have come across a few that says that you cannot sell the item as stand alone which makes me confused...So lets say i purchase curtains and texture them what would i put with it if i cant leave it as a stand alone item? and do i have to link this item to the curtain? To me it's confusing meaning if someone wants to buy curtains why would they want something else attached to it? or does it mean i have to put it in a package of lets say 5 items like a scene and sell it that way? i usually stay away from that term and prefer items that i can buy and texture and resell as one item...Hope i make sense...

If you buy mesh curtains (untextured, just a mesh object), you can't turn around and sell it again as is. You have to do something to it to make it yours -- like texturing it.  After all, you didn't make the mesh object, so you can't legitimately resell it as if you were the creator.  The warning makes sure that you understand that. YOUR creation is the textured mesh object.

Absolutely,i retexture it everytime, i would never sell it without doing anything to it but i was told from some that isn't enough, which to be honest it's what  i thought the term "cannot be sold as a standalone" meant originally so long as i retexture and change the seller on it to myself and it's why i was confused...

That's probably a question to ask the seller of the full perm item.

Indeed.  You are in the realm of "derivative work" -- work based on or derived from one or more already existing works.  If you are claiming copyright of a derivative work in the U.S., you have to show that you have made a "substantial" change to the original, and it's up to the copyright office (and ultimately the courts, if it comes to that) to determine what ":substantial" means.  Here in SL, you aren't claiming copyright but the creator's interest is the same.  She doesn't want to have her work devalued by having you claim that YOU are the creator, so it's up to you and her to agree on what "substantial" means.

In general, most mesh creators in SL will be satisfied if you sell a textured version. I suspect that even more will be satisfied if you sell a scripted version or something that incorporates their mesh as a link in something else.  They may qualify their agreement by saying that your product must be no mod, so whoever buys it from you can't then remove your texture or script, or unlink it and sell the original again.  As Rowan says, however, the best way to be sure what the creator thinks would be a "substantial" change is to ask.

I would advise asking creators. Usually they are pretty specific to not selling with full perm permission attached to yours.

I would think after reading the tos that you could use it in a build and resell but just texturizing might be going against their tos.

you could add fairy lights or something to change it up but you really need to clarify with the person who is selling the full perm
