the system failed to deliver items that i payed for on marketplace but it says they where delivered

Go to your marketplace transaction history (top right of the page, my marketplace). Copy/paste your transaction number and send a notecard to the merchant explaining your problem and asking for redelivery. You will have no problem to receive a new copy of your item.
