If you released it full perms, no TOS or copyright has been infringed. Also if you just modded something, you don’t have copyrights.

Actually it depends on the license terms included - if there were none... I would never ever give away anything fullperm for free, as sadly a lot of SL users do not understana how user licenses work on top of the permission system...

As you said you just modded the item yourself - do you think the original creator would be happy if you gave it away fullperm again (some would be, but even those can contain user licenses like the free to mod and redistribute Arcadia Asylums items)?

Darn it.  I guess this year we'll have to include a license with any full perm Advent gifts, something like "You are welcome to enjoy this item and even give away copies, but you MAY NOT SELL IT."

It was given away full-perm.  If there were not any terms and conditions included with it,  I don't see how a DMCA could be filed.  They didn't steal or copy it.  If no terms, then nothing to say not allowed to sell it.

I agree with most other people. It was full perm without terms and conditions. DMCA doesn't cover that sort of mistake.

File a DMCA takedown. That's all you can do.
