Question

Hi, I was wondering if the following constitutes a violation of TOS:

Taking a picture of myself with other residents and send it to my profile's feed with the name(s) of the residents that are on the photos. Photos are taken on public sims. The residents I take a picture of are engaged in a common activity with me and not random strangers i see in SL and I am always in the photo too.

According to the exceptions of disclosing personal information (http://wiki.secondlife.com/wiki/Linden_Lab_Official:Residents'_privacy_rights) information on the resident's profile is not considered a violation of TOS. The residents name is visible on their profile. I really want to clarify this.

Thank you for your help.

This is not a violation of the Terms of Service, nor of any of the associated Linden Lab policies.  The policy that is most clearly applicable is the "Snapshot and Machinima" policy: http://wiki.secondlife.com/wiki/Linden_Lab_Official:Snapshot_and_machinima_policy

In this policy, it explicitly states that you do not need to get other avatars' permission to take snapshots (although you do need it to take machinima (video) of them).  You may even take pictures of random strangers, and you don't have to be in the picture.

Do be careful about "public sims".  If the land is truly public, i.e. owned by Linden Lab, all is well.  If it is any other "public" venue...a store, a club, a roleplay area, a park...it's really privately owned, and the owner may have a policy about snapshots and machinima.  Look in About Land.

See a list of all policies here: http://wiki.secondlife.com/wiki/Linden_Lab_Official:Policies (there's a whole bunch of them!)

NOTE:  I Am Not A Lawyer, and I Am Not A Linden.  (IANALx2)  The foregoing is my personal opinion.  Follow it at your own risk.
