If you own the Intellectual Property rights on the original work, then you can file a DMCA complaint with Linden Lab.  Under federal law, they are required to remove any items that are the subject of a properly-filed complaint.  They will not respond to a claim by someone other than the creator of the original work, however.  Please read http://wiki.secondlife.com/wiki/Linden_Lab_Official:Intellectual_Property and http://secondlife.com/corporate/dmca.php for details of the applicable policies and instructions about how to file a DMCA complaint if you are the intellectual property holder.

FYI -- This is a resident-to-resident Answer service.  We are al SL residents like you.  Lindens never come here or respond to posts on this site.

Lucretia is right about the creator giving rights for NON COMMERCIAL use.  In my opinion, since the seller is charging money on the Marketplace, this is a commercial use and is in violation of the creator's express wishes.

However, you can't really do anything except notify the creator of what you have found.  I would see if you can contact him through that CG sharing web site and give him the links you posted here, as well as a copy of LL's DMCA policy.

It's up to him to take it from there.

He has released his art to the public...

"Here are ten 'helms' modeled around M4's head in Wings3D - they are in .obj format for import into Poser and DAZ Studio, or any other 3D program that takes this format. Each helm has its own color and displacement maps, but see the ReadMe for best settings. For description see pictures - (M4 and his clothes are not included). These models are free for commercial and non-commercial use - with a mention if possible."

There isn't a DCMA violation per-se upon the original creators product.

The new use of the Public Domain Mesh mask in a finished product should give lip service to the original creator but is not necessary.
