Asking is not against the ToS. What is against them is disclosing personal information without the other person's consent.

And, if you are being asked, you are not obliged to answer. That is really within the ToS. :smileywink:

Disclosure

Residents are entitled to a reasonable level of privacy with regard to their Second Life experience. Sharing personal information about your fellow Residents without their consent -- including gender, religion, age, marital status, race, sexual preference, alternate account names, and real-world location beyond what is provided by them in their Resident profile -- is not allowed. Remotely monitoring conversations in Second Life, posting conversation logs, or sharing conversation logs without the participants' consent are all prohibited.

Val is absolutely right. Linden Lab is not asking for this information so just say no to whoever is demanding it from you. If the person persists in demanding the information, just mute him/her.

Whenever people ask nosy questions, if I am feeling generous I tell them, "you can ask, but I might not answer". If I'm feeling ornery, I just say, "that's a rude, nosy question. " people can 'demand'all they want, but you are not obliged to provide anything you don't want to.
