  1. They make those rules so they can DMCA the product you make from the full perm item, by either selling it too cheap or selling it with the wrong permissions. And yes linden always listens to DMCA's in my experience. Can't use their image means you can't use the vendor image the creator used to sell the full perm item to sell your non full perm item you create from the kit. You have to make your own image to sell the product you have created from improving their product. I find it ridiculous that template makers would give you full perm textures then won't let you use them, there is one template maker that is super famous for DMCA people who use the textures she sold them. 🤷‍♀️ I believe the creator made this stupid rule because they don't actually own the mesh models or the textures they are selling full perm and have purchased them from 3D Mesh Model Sites then rigged them for SL bodies. Often the rigging is low quality too. The giving the full perm item to alts generally refers to giving full perm things you purchased to your alt to create things for your alts shop then selling it. The main point for removal or enforcement of the full perm object creators TO's is when they are selling the item in a store or on the marketplace. It's not very often people DMCA your inventory unless you are profiting from there creation. You often find copy bots (or unreputable sellers) sell from there inventory to yours for this reason and have no stores. You don't actually tell linden your TO's on the DMCA fax, but you state you own the copyright. All creators hold the copyright on there original creations. If the creation is prim, mesh or an image etc. ❤️ The next point after that is contesting the DMCA and linden will give you the contact details of the person who DMCA you so you can get RL lawyers and go to RL court if you want to pursue the matter. At which point it is my understanding the court will ask you to prove that you created the item by showing your work flow.

    Hypnotically speaking, i know of a situation that could be either be false or true where a person has been accessing second life accounts and have been sharing messages with others. They supposedly work with LL. Nothing has reported anything because no concrete proof has been received. What is DMCA and how is this relevant to someone being able to access to messages and account period even after numerous times of changing passwords and paying for security? Any advice would be great. Than you.
  3. Let's say that I was in one of those videos. I didn't give my permission to post it on YouTube. I file a DMCA. How in the world would YouTube know that I am the owner of that avatar and it's content theft? Maybe I'm just an avatar that has my own videos and want theirs to go away. I don't see this as being successful at all and if that were me I'd be pissed if someone filed a DMCA to take down a video without having to show proof. I doubt YouTube is going to sign into SL to verify that indeed the content was stolen. I'm not even sure it's copyright infringement.

When we use Other People license (closed or open source) is still incumbent on us to do our own legal due diligence when we include a licensed work in our own work for example, just because I include a Public Domain notice in a script I might post to the Scripting Library it means that the Public Domain notice applies only to the script as a whole body of work. My Public Domain notice doesn't mean that I am necessarily the legal owner of all methods that may be included in the posted work. Methods can be encumbered by patents and/or user licenses that can come back and bite us when we not careful pretty much yes to both points generally in most countries we can't dictate on-sell prices unless the product is part of a franchise agreement and in most countries we can encumber a user license with pretty much anything we want (Linden Terms of Service for example), provided that we also provide a legal dispute remedy. Is not enough to just say to the customer that the legal remedy is DMCA. We typically have to do more than this not making a User License available before purchase, is usually legally actionable as a dispute. In this case we could petition Linden to make us whole. Get our money back and remove the product from our inventory. If Linden doesn't do this then we can use the Linden Dispute Arbitration process. https://wiki.secondlife.com/wiki/Linden_Lab_Official:Terms_of_Service_Arbitration_FAQ basically in the do-nothing case we sue Linden for enabling this to happen on their site however, from what Orwar says the seller has addressed this issue by providing a Demo Product accompanied by a User License. My assumption is that the demo is not the Full Product which the user can buy after reading the User License we received the User License before we purchased the Full Product. Typically in this case the act of purchase after receiving the User License would be seen as agreeing/signing in most jurisdictions
  5. The best solution is to not engage, eject on sight. I watch some of these trolls on YouTube and people have a (very high) tendency to want to engage and ignore land tools (EG: "GET OUT IF MY HOUSE!"). One of the trolls I watched said he only goes to places he knows he can get a reaction, and he avoids places that quickly eject, because it doesn't make for good YouTube content. Don't encourage DMCA abuse.

    DMCA is strictly for copyright infringement. If you made something and someone stole your content, you'd file a DMCA. IP Infringement Policy | Linden Lab People are always saying they 'work for LL'. People who work for LL are either Moles or Lindens. If you think someone has accessed your account, you should report THAT too LL. They may suspend your account, however, while they investigate. If an LL employee were on their personal, non-LL account, they certainly would not be infringing on anyone's rights nor accessing their IMs.
  7. They allow it to happen because... Nobody TOLD them it was happening. The movies are NOT stored on their platform, the TV connect directly to an external website via a script. LL won't disable scripts from charging people money as that would break EVERRY store vendor system in SL. They won't stop scripts from acesssing external websites, as that would break a ton of stuff too. They certainly won't disable "media on a prim" either, for the same reasons. The only way to shut this down is either somebody telling the copywrite owners and them filing a DMCA against the website hosting company, or somebody filing an Abuse Report, and LL "generously" interpreting their ToS and banning the manufacturer of the TV in question and removing all examples from SL (highly unlikely to work). Just like RL crime, if nobody reports the crime, law enforcement won't know it's happened and won't do a damn thing bout it.

The legal action was actually started by the company that was the skeevier one, but it was in response to a DMCA takedown from the other. It ended up in a semi-confidential settlement. A couple more similar episodes - in the early years of mesh bodies somebody started sending DMCA takedowns over dubious claims. They drove Wowmeh out of business but then made the mistake of taking on Belleza, who lawyered up and discovered that the claim was within tolerance for flat-out fraud. Circumstantial evidence would indicate that the original DMCA-sender ended up getting their booty banned from Second Life, under multiple names. Then a head maker went ballistic over UV layouts with another - it ended up with both parties still in business and no finding of guilt. The aggressor probably should have worried more about making heads than their "intellectual property" because they've been floating around the yesterday bin for a while now.
  9. This is pretty pathetic, for a company that's entire existence and business model is online, to not have an online DMCA form or email to send one to. We're supposed to snail mail it or fax it over, really? REALLY. There are people alive now who've never even seen what a fax machine looks like and you want us to send a removal notice on ancient devices. What a convenient way to keep making money off of stolen goods on their marketplace, by making it more difficult for people to report theft. Get it together, SL, join us here in the year 2023 and give us the goddam digital option.
  10. Is this allowed??? I'm new to Second Life, but in games like Minecraft, etc. People LOVED compliments and people being inspired by other builds for being aesthetically pleasing. It went like this, I said 'Did you build this?', and then he replied with 'yes'. I said afterwards, 'I love it! You're very talented.' And he said 'ty' and so I told him why I'm here and I wouldn't be able to afford a L$15,000 price tag on his building, I'm just here to draw inspiration from and get ideas. He then followed with 'I will file a DMCA against you if I find anything copied'. I told him how I would NEVER ever copy somebody. He said I am obviously going to, as I said it previously. But I never used the word 'copy'. Or to tactfully do that even. I wouldn't even replicate it with my own creative ability - I couldn't even. So my question is this. Is that a valid thing? Can somebody do that? Now I'm freaked out about going around visiting other peoples creations because they look cool. There is in no way that I am going to be copying somebody. It's like going on Google Images, or a book, or somewhere where there is architecture. And then going on to build similar shapes, etc. Like then everything is basically copied?? I really don't understand. Could somebody please sum this up for me?
  11. Very easy, block them inworld should do the magic trick. But... accusations about copybot are pretty serious, you háve to report that to LL, ánd file a DMCA if the ownership is theirs, if it isn't... you'r possibly out of luck to stop somebody copy it ( copy and copybot are two totally different things. The first is re create a item, the second is breaking the c/t/m settings of a original item) Simply blocking one person won't help it at all, any alt/throw away account can still buy the item and keep going on with the behaviour.

There have been a few posts lately about copyright and trademarks that I was curious if anyone has/or knows of someone that successfully sued a private person in Second Life, won and actually collected damages? I'm not talking about Filing a DMCA or companies such as Disney but a creator actually suing another resident for use of their items in any way not authorized. Not someone suing Linden Labs directly. It is my opinion that there is a lot of fearmongering going on from people that post things as fact when they are not qualified in the legal field whatsoever.

  14. It's no fearmongering, breaking copyright/trademarks is breaking a law, and cán cause a lot of trouble, for that you don't need a qualification in the legal field. And as it is protected, it cán lead to expensive and long lasting conflicts when lawyers get put on such cases. BTW if somebody wants to put a claim on the table, a DMCA is required for a company , as SL, and others, to act on a claim. Most cases end in a settlement without going to court. And íf somebody lost... do yo think they want to have that announced? It will ruin their brand. Often a slight change in a design is enough to get cases being dropped.
  15. I sometimes forget why the Maitreya shoes doesn't fit on my LucyBody until a "Slink feet, oh yeah" light bulb goes on. XD But I'm not mad about it. I'm guessing that's how the LucyBody owner managed to avoid a DMCA takedown. My experience closely mirrors yours with Kalhene. They are shooting themselves in the foot for future sales with abysmal customer service. I would've considered getting Erika for an alt or two if they hadn't pissed off the Analexa customers. Gee, I wonder why Erika isn't as popular as Reborn & Lagacy. Speaking for myself as a consumer, a new body would have to be distinctively unique, have mod permissions, have enough clothing & skin support from the gate, and backed by good customer service. The female body market is oversaturated so a creator would have to offer something that other garden-variety cis bodies don't have. Modifiable permissions has become important to me. I like being able to manually control the shine and gloss, and develop BoM nails. Belleza, CZ Slim, and Anatomy allow me to do that. I could never go back to a no-mod body.

  17. So far as I can see the links posted show two options removing completely or just removing from sale. I think at least that is what "remove or disable access to the material" means. The only examples I am aware of where DMCA takedowns resulted in them removing things from the servers was with regards to copybot dances, including a DMCA Akeyo originated where Linden Lab removed Akeyo's own dances along with the copybot ones resulting in people losing dances they paid for temporarily, until Akeyo managed to get that fixed.. I don't recall how exactly it was a long time ago, but I do remember consternation of myself and friends having dances we paid for removed. Now I am of course just citing my own experience, but it is sufficient to show your claim "DMCA items are removed from all LL servers until the legalities are resolved" is incorrect. Wowmeh and Genus are sufficient to show that. I am pretty sure the same applies to some Harley motorbikes that got removed from sale and the maker ultimately banned (for relisting them)... the bikes however remain. You now say "in most cases", whereas before you said "all".. "most" may or may not be correct... my limited sample of experience insufficient to support or contradict the "most" claim. But what makes you think most are? the only examples I am aware that have been removed from the servers are dance animations.
  18. In most cases, yes that is how DMCA works by law (17 U.S.C. § 512). Counter claim https://lindenlab.com/legal/intellectual-property-infringement-notification-policy LL can and does pick and choose what if anything remains on the servers including scripts that may break things other than the DMCA item by removing them. It doesn't do a damn bit of good to remove from sale DMCA items from the MP and NOT remove them from sale inworld.
  19. I think it's okay to use stuff at home but not if you're selling it. If it's a public place its possible someone from KFC comes to your land and DMCA you though because they own the brand.
  20. One thing to note too, many of these take downs are probably done by the shop, not SL. I've bought these types of items before, I don't think I've seen anything thing removed from my inventory (Still have my Eevee pet), if it were a DMCA, it would be wiped from your inventory. So it's probably shops who have ether moved on to other things, and/or shops who have realized how dangerous it is to sell these items and don't want to get a DMCA.
  21. Thanks for filling us in on the background here. My responses may be pretty "qualitative". 1. How long have you participated in Second Life? Since May 2006 2. How many hours per week (on average) do you participate in SL? 20-ish, depending on if I'm in town and whether there's an interesting script to work on 3. How much time have you invested in your avatar? Less than most, probably, but longer than I'd like. I don't find it particularly enjoyable and it's stupidly difficult to get desired results (In case you're really asking: Qie has a specific "look" that I try to preserve and update as SL avatars improve) 4. Do you make your real identity known, or do you remain pseudonymous? I share some incidental real life stuff with SL contacts, but I'm pretty fastidious about maintaining separate identities. Inhabiting a separate identify for part of the day is a big part of the fun 5. What is the worst thing a person can do in SL? By far: Revealing somebody else's real life personally identifiable information Now, trying to read between the lines, I gather you're specifically interested in the intellectual property of the user's in-world identity. Two things about that: First, the junk we drape our avatars with is extremely ephemeral. Folks may have some identifiable content that sticks with them outfit-to-outfit, across avatar bodies and over time, but it's like the Ship of Theseus: that junk can come and go and the "essence" of the identity is preserved. That can be true even shifting human to furry to mech to amorphous blob (blobs unite!). And so the big threat to that "identity IP" would be an AI deep fake of our generated chat content (text or voice, both are spookily easy to spoof now), and that is the IP that's least defined. (Ask the Writers Guild of America.) Second, I came to SL originally at the crest of a wave of interest in the IP of virtual goods (following up on a Doug Kaye IT Conversations podcast, for real old-timers). Turns out that's boring, just throw a little DMCA at it and it's solved enough to let the lawyers haggle like it's property law, nothing socially significant to see here. More challenging: the economics of preserving open IP. Sure, can stamp it GNU (or Mozilla or BSD or whatever) and it's formally blessed, but the same DMCA flag-wavers just can't stop themselves from trying to "protect it from" being as open as the terms demand. (Try to find a product that actually complies with the AVsitter open source license, for example.) Sure, the IP is technically, legally open and "that's what matters" but practically there's nobody with economic incentive to promote and protect those terms in the marketplace. And so freebies get resold and disgust is the sole enforcement.
  22. The rights holder has to contact LL for it to be removed. Copyrighted material on marketplace falls into three basic categories 1. Merchant has worked a deal with the IP holder of the copyright material and it's legitimate 2. The rights holder doesn't know the infringing IP is being sold and hasn't filed a DMCA yet 3. The rights holder knows the infringing IP is being sold and doesn't care because they'd rather have the advertising or whatever while someone makes money from their IP The rights holder technically owns the rights to everything on the grid that uses their IP, so if they file a DMCA and want it removed entirely from the grid, it can be. If they just want it removed from SLMP and being sold, it can stay in people's inventories.
  23. DMCA items are removed from all LL servers until the legalities are resolved. If the DMCA is not disputed, the items remain gone. If it is disputed the items are "returned" to the servers. If the one who disputes loses the court case, the items are permanently removed.
  24. Hi I was wondering if we would get in trouble for wearing a vest we bought in secondlife that now has a dmca against it. What are the rules about that? Can anyone help?
