You pose an either or.

Either XStreet and SL are too preoccupied to shut down the use,

Or you are missing a technicality that allows the use.

Neither premise is true.  Ok?  That is the answer to your question -- your question cannot be answered logically, since neither premise is true.  No and No. Got it?
