Skill Gaming Policy

Question

I guess this is over my head. I have been playing the "skill gaming" for years. Now all of a sudden I can't because I live in Kentucky. Can someone show me where it is against my state law to play a game? We are home of the Derby one of the biggest gambling days of the year. We have bingo halls, state lottery, yet I can not use my "play money" to play a game? Do I sound like a whiner? Probably but that is the main thing I do in SL. I have been age verified, I have payment on file. Everyone else except 10 states can go to any grid they want. So does that not seem a bit discriminative? Not that anyone will actually answer me. Show me the LAW that says I am not allowed to play gambling games online. That is all I want to see.

I think you'll have to take it up with your state Gaming Commission.

I have no more idea than you do what law applies, but my guess is that Kentucky has passed strict laws against internet gaming, presumably to keep all the gambling profits in state.

If you have questions about the law you need to consult a lawyer or your states gaming commission.  I am not a lawyer but I googled it and found that while there is some forms of gaming allowed in Kentucky, online gaming is prohibited.  I found this from the Washington Post about Kentucky seizing online web sites in October of 2008.  I've quoted some relevant points here.  The bolding is mine.

'Attorneys for the state convinced Judge Thomas Wingate that the gambling Web site names were tangible "gambling devices" that could be seized under Kentucky's gaming statutes. Wingate's order compels the entities that manage the registration of those domains, known as domain registrars, to transfer control over the Web sites to the state.

Jennifer Brislin, spokeswoman for the Kentucky justice department, said the state is seeking unspecified damages from the casinos, but that its primary goal is to force the Web sites to block Kentucky residents from visiting them. She said the majority of the registrars affected by the judge's order had "locked" the domains in question to prevent them from being transferred to another registrar pending the outcome of the case"

I am sure LL doesn't wan't SL to be seized by your state so they are taking no chance and are not allowing you into Skill Game sims.  A wise decision.  You should take it up with your state legislature if you want to see it changed.

in Kentucky a operator must have a license granted by the State

Horse racing is licensed. And some operators for things like lottery, bingo, etc are granted licenses to raise funds for charitable purposes

electronic devices are specifically excluded in the legislation. Cant get a operator license for these

However is legal in Kentucky to bet on a game of skill. But the game cant be electronic
