how do i create an animation and can i get sued by the company it came from if im successful ?

There are many animation creation tools, some even in-world, some external such as QAvimator. You'll also see plenty of video tutorials for many of them, after some Googling.

And yes, you could get sued, or at least get into some trouble, from purposely (and too closely) copying an existing creation, whether it's an animation, a character, a building, a piece of clothing...
